  1. ++Witness from IL Assoc of Fire Protection Dist says depts can’t be responsible for hydrant upkeep when they don’t own them.++ Homeowners do not have the skills to upkeep the fire hydrants placed on their property by the city! This is bull!

    I’m assuming its the same principle as with water lines and sewer lines. If it’s on your property it’s your responsibility to maintain.

  4. Sidewalk or whatever other line exists if you don’t have one. I was assuming they were talking about hydrants that are actually on people’s property. Maybe I was wrong in the assumption.

Argument that DeVito never presented in his brief (and should have) is that the SB 1 is also subject to a challenge under the “takings clause” of the federal and state constitutions — essentially, SB 1 purports to take away property without any due process of law. This an an argument worth considering, because the “takings clause” is indeed absolute. If someone has property that is taken by the State, then the State must compensate that person for taking the property. This is the constitutional principle that is much more analogous to the pension-protection clause.

  7. In regards to water lines, and I speak only for water lines, you are responsible from the meter to your house everything up to the meter is the systems.

  8. Doesn’t matter how far into your yard the meter is.

    Fire hydrants are typically owned by the water system.
