Madigan files identical bill to Rauner’s AV, plans hearing

Thursday, May 17, 2018 - Posted by Rich Miller

* House Speaker Michael J. Madigan…

“The issues the governor raised in his amendatory veto of House Bill 1468 deserve a full hearing and consideration before the House. With this in mind, we have filed an amendment to Senate Bill 2580, containing the exact language the governor suggested. The amendment will be sent directly to the House floor this morning and a subject matter hearing on the measure will be held on Monday afternoon. We look forward to hearing from stakeholders and continuing our effort to keep our children, our schools and our communities safe from senseless gun violence.”

The amendment is here.

“All Republicans need to vote present on this.” Fake Governor Rauner.

  2. - SAP - Thursday, May 17, 18 @ 10:41 am:

A fair and impartial hearing before the execution. Classic Madigan.

  3. - Burrito - Thursday, May 17, 18 @ 10:42 am:

How you like dem apples Bruce?

  4. - 360 Degree TurnAround - Thursday, May 17, 18 @ 10:43 am:

Does this mean we are going to have a committee of the whole? I hope so. That is like Christmas Eve and the Fourth of July rolled into one.

  5. - Leigh John-Ella - Thursday, May 17, 18 @ 10:45 am:

    It’s Rauner’s Gross Receipts Tax.

  6. - VanillaMan - Thursday, May 17, 18 @ 10:48 am:

Governors need to have working relationships with other government branches in order to successfully pass effective legislation.

If a governor fails to do that, they may end up merely spouting useless political slogans which would immediately fail in the legislature.

With Rauner, every lesson was ignored so that we could all see him fail at basic governing.

Three years in office and he still tilts at the windmills in his mind.

  7. - Real - Thursday, May 17, 18 @ 10:50 am:

I believe Madigan will call it for a vote. And if it passes it will put Rauner on the spot. Let him reinstate the death penalty. It will ensure he is 1 term.

  8. - wordslinger - Thursday, May 17, 18 @ 11:01 am:

The governor brought up restoring the death penalty out of nowhere. If he is to be taken seriously, a thorough discussion of such a momentous change in law is in order.

The governor is to be taken seriously on the matter, is he not? Someone who would just throw the death penalty into the public arena for a cheap political stunt would be unworthy of the office.

  9. - allknowingmasterofraccoondom - Thursday, May 17, 18 @ 11:02 am:

Madigan is a political genius, in case anyone was wondering .

  10. - Concerned Dem - Thursday, May 17, 18 @ 11:06 am:

I wonder if the ISRA & NRA will still be applauding this AV if it actually passes.

  11. - dbk - Thursday, May 17, 18 @ 11:12 am:

This is an example of MJM as grand master of political chess - and BVR as, well, never mind.

The guv should maybe look up the meaning of “hoist with his own petard.” Because this is textbook.

  12. - Oswego Willy - Thursday, May 17, 18 @ 11:17 am:

Rauner should be able to get 60 in the House…

Heck, Rauner should really show that Madigan and get those 60 on the stairs behind him, and Rauner should stand behind a podium, with microphones, and say…

“Here’s my majority in the House, Speaker Madigan, your bill proves my point”

    Boy, that’ll learn Madigan good.

  13. - Baggs McCoy - Thursday, May 17, 18 @ 11:22 am:

I can’t wait to see all of Madigan’s members voting against a bump-stock bill, more money for school safety, an expansion of the 72 hour waiting period to buy a gun. And yes the death penalty for cop killers and mass shooters. This is not a repeat of Blago and GRT.

  14. - Oswego Willy - Thursday, May 17, 18 @ 11:28 am:

    ===I can’t wait to see all of Madigan’s members…===

You’re of the belief the HGOP (HRaunerites) will all be Green on this? That may be, but…

… these type of bills were considered “Sham” bills back all those months ago, when the “Superstars” were shaking and bringing back and before Rauner, as a white male, hadn’t signed things like HB40…

… but please, let’s talk about the HGOP (HRaunerites) locked Green on this.

If it wasn’t for the death penalty, it could get 60 and pass, but that is not what it was designed to do.

  16. - unclesam - Thursday, May 17, 18 @ 11:41 am:

Any committee hearing will be “subject matter only” as the Speaker has already sent the amendment directly to the House floor from Rules.

  17. - Anon221 - Thursday, May 17, 18 @ 12:01 pm:

In the AV, Rauner inserted this language into the bill:

    (720 ILCS 5/9-1.5 new)
    Sec. 9-1.5. Death penalty murder.
    (a) In this Section, “human being” means a person who has been born and is alive.

Just wondering… why was this inserted? Any possible tie to HB40 and Roe v. Wade issues? If I’m really off base and this is a consistent definition within Illinois law, just tell me.

If a pregnant woman who was near enough to term, was shot and killed, and the fetus killed, although it might have been able to live if a C-section had been able to have been done, does that count as two human beings, and thus the shooter is now a mass murderer?

it just seemed like a very curious change/insert into the AV.

  18. - Chicago_Downstater - Thursday, May 17, 18 @ 12:05 pm:

Look I love a good political play. It’s part and parcel to our system of governance. However, I got to say playing around with the death penalty is a step too far.

We are literally debating whether we want to bring back the potential for the state sanctioned murder of wrongly convicted people just to rally our political bases. And I don’t particularly care if Rauner started it. Madigan shouldn’t continue it just for the sake of a couple of political points on the board. They’re both in the wrong here. And this is ridiculous.

  19. - TominChicago - Thursday, May 17, 18 @ 12:12 pm:

Baggs McCoy - I think you are ignoring the duality of this bill for the dems. In those districts that are anti-gun control and pro-death, the Dem can say, I voted against the bill because of the gun stuff and in a district that pro-gun control and anti death, he or she can say that they voted no because of death penalty. A republican can only vote for gun control or against their governor.

  20. - 19th Ward guy - Thursday, May 17, 18 @ 12:19 pm:

Executing those who murder police officers is a political winner. Please, lets debate this and we can point out the failure of the goo goo Liberal great society policies that nearly destroyed the inner-cities. Please, let’s have this debate.

  21. - Mama - Thursday, May 17, 18 @ 12:30 pm:

If it passes both houses, will we really reinstate the executions in IL?

  22. - anon2 - Thursday, May 17, 18 @ 12:41 pm:

Will Rauner support his own proposal? What about Durkin?

  23. - Baggs McCoy - Thursday, May 17, 18 @ 1:08 pm:

I understand the reality of this bill for HGOP. The downstaters are in a trick back as well. But, in the end I think if Madigan puts this on the board it gets 60 votes. That is a win for the Governor period. There certainly is less clarity in the senate. This war is between the Speaker and the Governor. The Governor would love a win in the Speaker’s chamber.

  24. - Oswego Willy - Thursday, May 17, 18 @ 1:10 pm:

===But, in the end I think if Madigan puts this on the board it gets 60 votes.===

    With the death penalty provision?

    Hmm.

  25. - Oswego Willy - Thursday, May 17, 18 @ 1:18 pm:

===That is a win for the Governor period.==

Rauner should come back to Springfield, get your 60 on the stairs and really embarrass that Madigan.

That, of course, would mean the 60 exist, and see that AV as the right thing, as that language is exacting to that AV.

Wishing something and actually having the 60 noses, with the complexity of this, including the death penalty provision…

    Whew.

Legislators need to have working relationships with the executive branch in order to successfully pass effective legislation. If legislative leaders fail to do that, they may end up merely spouting useless political slogans which would immediately fail on the Governor’s desk.

===If legislative leaders fail to do that, they may end up merely spouting useless political slogans which would immediately fail on the Governor’s desk.===

… then Rauner owns his vetoes…

All his state agencies, funding them…?

    Rauner vetoed that.

    All the state universities… funding them… ?

    Rauner vetoed that.

According to you… then the budget crisis, the vetoed budgets, the crushing of social services…

“If legislative leaders fail to do that, they may end up merely spouting useless political slogans which would immediately fail on the Governor’s desk.”

Rauner vetoed all that, purposely… to hurt so many.

Maybe you need new programming, as Rauner has said he’s not in charge, so while you may be correct, and then that puts into focus Rauner’s failures, Rauner says he’s not in charge, as you seem to think a governor should be, and that’s a Rauner failure too.

    lol

    I’m here, you jamoke.

–Should we start at the former Cabrini or maybe Henry Horner. The great society did a centuries worth of damage to the urban communities. –

Cabrini went up in 1942, the Horner homes in 1957. They’re both long-gone. How many “centuries” make up the Great Society for you?

But I do admire your principled stand to refuse Medicare when the time comes.

You are going to refuse Medicare coverage, right? Because… principles.

  36. - Stuntman Bob's Brother - Thursday, May 17, 18 @ 8:53 pm:

Personally, I’m on the fence when it comes to the death penalty for any 1st-degree murderer, not just cop-killers. I appreciate both sides of the argument, and see this as an opportunity for some out-of-the-box thinking. Perhaps we need an even higher standard of proof than “beyond a reasonable doubt”. And for those that meet this criteria (Gacy, Manson, Speck, McVeigh, Bundy, etc. would be poster children for this), lifetime sentences of hard labor could be imposed - or maybe even stripping them of citizenship, so they could be deported (”sold”) into a prison system in Central America or Africa, where they would serve their life sentences with a much less total dollar cost. The benefits to the country would be obvious, without having the downside risks of capital punishment - and could represent a compromise between the “For and Against” sides of the issue.

  37. - wordslinger - Thursday, May 17, 18 @ 8:57 pm:

–What does the Great Society have to do with the death penalty?–

Nothing. 19 Ward dude has been taking the long way down Western Ave.

    Mama, yes that’s the goal.
