If you want a state grant, you have to follow state laws and rules

Illinois Gov. JB Pritzker is threatening to withhold federal funds from local law enforcement if they refuse to enforce his executive order.

The Illinois Emergency Management Agency (IEMA) sent a letter to local police officials on May 20th, warning them that federal funding could be withheld from their department. The letter said, “Failure to execute or enforce the [executive order] could be considered noncompliance with the [Public Assistance Program Grant] Agreement condition to comply with all applicable state laws, regulations and policies thus placing the applicant’s funding in jeopardy.” […]

“To threaten any law enforcement agency that they’re not going to give us funding, that’s bully tactics. And I’m not going to be bullied,” said Winnebago County Sheriff Gary Caruana.

Ogle County Sheriff Brian VanVickle added, “It is outrageous that the Governor is threatening retaliation against these leaders and the men and women of their offices. He is insulting heroic police officers, corrections officers and local voters.”

OK, now read the state’s letter. You’ll notice that in order to receive federal disaster funding from the state (which is the grant recipient), local law enforcement agencies must certify they are complying with “all applicable federal and state laws, regulations and policies.” If those agencies claim to be following those laws, regulations and policies and are not, they can lose their funding. And if they’re not obeying Pritzker’s EO, the state contends they could be ruled out of compliance for the grant money.

That’s pretty standard stuff for almost every sort of federal and state grant. Nobody, but nobody is entitled to grant money if they’re not following the rules. Kinda weird that some sheriffs are claiming to be above the sort of law that everyone else has to follow if they want government money.

Also, federal regulations prohibit disaster relief to an applicant for “damage caused by its own negligence.” Reopening in advance could trigger that regulation, the letter states, “if the act of reopening resulted in increased costs for emergency protective measures.”

“must certify they are complying with “all applicable federal and state laws, regulations and policies.””

That boiler plate verbiage will get you every time. Kind of like the terms of service for the internet. Everyone checks the box but doesn’t read the fine print.

  2. - Just Me 2 - Friday, May 22, 20 @ 1:49 pm:

As a reminder, Republicans are always saying federal money should be denied to sanctuary cities because, “They’re violating the law.”

  3. - Pearly - Friday, May 22, 20 @ 1:50 pm:

If you want to run your little county like a fiefdom, there are consequences. Did these people really think they’re entitled to make and enforce laws by fiat?

  4. - Oswego Willy - Friday, May 22, 20 @ 1:53 pm:

=== Nobody, but nobody is entitled to grant money if they’re not following the rules.===

… the rest is the realization of what is currently happening, and if you’re drawing a line in the sand here, that’s the hill you will find yourself arguing… maybe against yourself later.

It’s a tough way to go about the business of governing, and keeping it compartmentalized will be… something too.

  5. - Oswego Willy - Friday, May 22, 20 @ 1:56 pm:

    To be clear;

=== Nobody, but nobody is entitled to grant money if they’re not following the rules.===

I absolutely agree… and by me doing so, that also means a realization what that all means by knowing that truth as absolute

  6. - Tawk - Friday, May 22, 20 @ 2:00 pm:

What about cities that do not enforce federal immigration laws?

  7. - Citizen Kane - Friday, May 22, 20 @ 2:01 pm:

I hope that means that they also have to enforce Federal Immigration Laws.

  8. - Lester Paul - Friday, May 22, 20 @ 2:04 pm:

“Enforcement” can be accomplished in MANY different ways. Not making arrests, as the Governor has suggested, does not mean no enforcement.

  9. - Flapdoodle - Friday, May 22, 20 @ 2:04 pm:

I agree with everything Rich says — follow the rules, reap the rewards; break the rules, pay the penalties. If ignorance of the law is no excuse, it’s no excuse for everyone, sheriffs included.

One thing concerns me, however. The Pritzker administration has not always done a good job getting these details in front of people in a way that is direct and easily understood. As is often said on this blog, the public doesn’t do nuance. One of my political mentors told me long ago that if your explanation takes more than two or three sentences, you’ve already lost. Pritzker and his staff aren’t really good at capturing the nub of an issue in a few sentences, but that’s what it will take with issues like this grant money.

I say this as someone much impressed with Pritzker’s performance throughout his time in office.

===What about cities that do not enforce federal immigration laws? ===

What about ‘em? Do any federal grants to states have riders that forbid this practice? If so, then they can be enforced.

    Wah Wah GIF.

The trolls will make the apples and oranges comparison to sanctuary laws in 3 … 2… 1

Everyone is so preachy about these rogue counties but less preachy when it comes to not enforcing the laws under the banner of bail reform or criminal justice reform.

  13. - Really - Friday, May 22, 20 @ 2:14 pm:

I agree. You can’t pick and choose what rules and laws you follow. Don’t follow the law? Don’t get the money. Pretty simple. Even for politicians and media members.

“Everyone is so preachy about these rogue counties but less preachy when it comes to not enforcing the laws under the banner of bail reform or criminal justice reform.”

Hey… that’s different because… well it just is. Quit complaining and get back in your house. LOL

  15. - Fighter of Foo - Friday, May 22, 20 @ 2:16 pm:

JB has lost. The people are done with this nonsense. Threatening law enforcement? How is this not scaring everyone? States that are open are thriving. No more nonsense.

  16. - Bruce( no not him) - Friday, May 22, 20 @ 2:18 pm:

As Sheriff, I know which laws I should enforce, and which to ignore. I don’t need anyone from the government to tell me what to do. ( I wish this was snark, but I’m afraid it isn’t)

  17. - Oswego Willy - Friday, May 22, 20 @ 2:18 pm:

    === JB has lost.===

    Cite please.

    Polling indicates otherwise.

  18. - Fighter of Foo - Friday, May 22, 20 @ 2:23 pm:

OW… Looking around and talking to friends and neighbors, the polls and his actions don’t reflect the polls. They will sink rapidly. Why do you think he did such a quick u turn on some of the restrictions? You’re one of the more intelligent guys on here..

  19. - Left Center Right - Friday, May 22, 20 @ 2:23 pm:

Typical liberals. Illegal immigrants violate the law. You just choose not to abide by it

  20. - Bigtwich - Friday, May 22, 20 @ 2:26 pm:

===What about cities that do not enforce federal immigration laws? ===

New York v. United States, 505 U.S. 144 (1992), held the federal government may not enact a regulatory program that “commandeers” the state’s legislative and administrative mechanisms to enforce federal law.

  21. - Oswego Willy - Friday, May 22, 20 @ 2:26 pm:

    === Typical liberals.===

Thank goodness. I was worried we wouldn’t have a mouth breather pointing at “liberals”.

=== Looking around and talking to friends and neighbors, the polls and his actions don’t reflect the polls===

    Ancedotal thoughts aren’t facts.

    Here’s one;

    Metra ridership down… 97%

  22. - DuPage Saint - Friday, May 22, 20 @ 2:28 pm:

I thought elected officials swore an oath to uphold the state and federal constitution and the law. I never really got that they would only enforce the laws they liked. But if good enough for them should be good enough for everyone. I have a few laws I might not wan to obey

  23. - From DaZoo - Friday, May 22, 20 @ 2:30 pm:

Another way I read this is the State had to put this letter out or possibly risk losing the Federal grant funds themselves.

  24. - Left Center Right - Friday, May 22, 20 @ 2:31 pm:

Absolutely agree DuPage Saint. Illegals are protected but business owners and religious institutions are threatened

  25. - Oswego Willy - Friday, May 22, 20 @ 2:33 pm:

=== business owners and religious institutions are threatened===

Are you always a victim or only during a pandemic.

    How are they threatened?

The Book of Matthew makes clear there’s no mandatory attendance… it’s not essential.

  26. - Oswego Willy - Friday, May 22, 20 @ 2:35 pm:

    Businesses are not threatened.

Follow the law, keep your license(s)

Pandemic or not, you don’t follow the law, you lose your license(s)

  27. - Left Center Right - Friday, May 22, 20 @ 2:36 pm:

So now the First Amendment goes out the window? Nice, unless the government infringes on OW’s rights

  28. - Left Center Right - Friday, May 22, 20 @ 2:37 pm:

But its ok for the city to ignore immigration law ??

  29. - Oswego Willy - Friday, May 22, 20 @ 2:39 pm:

=== But its ok for the city to ignore immigration law ??===

    Who said that? I didn’t.

Seriously, are you a victim ALL the time?

This isn’t a first amendment infringement.

I’ve yet to meet a shepherd thinking endangering the sheep is good.

  30. - J. Noble Daggett's Ghost - Friday, May 22, 20 @ 2:42 pm:

We are only locked down because we have consented to being locked down. Defy, Defy, Defy…they can’t arrest us all

  31. - Annoyed - Friday, May 22, 20 @ 2:44 pm:

holy moly LCR…what do you not get? A condition of the COVID Federal grant requires all recipients to certify that it abides by all local, state, and federal laws. This is Federal policy, not state.

  32. - Oswego Willy - Friday, May 22, 20 @ 2:44 pm:

    === Defy, Defy, Defy…they can’t arrest us all===

LOL, all 200 or so when you show up for 3 hours, with racist signs, hate speech, defying and maybe hurting others.

    Boy, you’re a real patriot.

  33. - Logical Thinker - Friday, May 22, 20 @ 2:49 pm:

This will not end well for JB.

If it becomes a popularity contest between the police and the governor, he will lose. And it won’t be close.

Why? Because the police keep the communities safe and live in them; the governor not so much.

  34. - Left Leaner - Friday, May 22, 20 @ 2:49 pm:

Police officers thinking the law doesn’t apply to them?

What a novel concept. During novel coronavirus times no less. *snark

  35. - Oswego Willy - Friday, May 22, 20 @ 2:52 pm:

=== If it becomes a popularity contest between the police and the governor, he will lose. And it won’t be close.===

    Huh?

That’s like saying “JB vs MJ in popularity”

    Your reaching… lol

    Polling is with the governor.

The Barney Fife sheriffs aren’t going to be running against the governor in 3 years.

Any other silliness, or are you going to add to a discussion.

  36. - @misterjayem - Friday, May 22, 20 @ 3:00 pm:

“Looking around and talking to friends and neighbors, the polls and his actions don’t reflect the polls.”

    Golly gosh‼

Well, if you say your friends and neighbors say so…

    – MrJM

  37. - Logical Thinker - Friday, May 22, 20 @ 3:01 pm:

My point stands on its merits despite your antagonism.

Law enforcement is much more popular than the governor. Always has been, always will be.

  38. - Oswego Willy - Friday, May 22, 20 @ 3:03 pm:

=== My point stands on its merits===

    lol, what “point”….

=== Law enforcement is much more popular than the governor. Always has been, always will be.===

    Cite please.

    Thanks.

  39. - Jocko - Friday, May 22, 20 @ 3:08 pm:

==Because the police keep the communities safe==

Are they planning on shooting the virus? Locking it up? Telling Covid to move to the next community?

  40. - @misterjayem - Friday, May 22, 20 @ 3:08 pm:

Every day for months, the usual suspects point to something new as proof positive that the state has/will/must turn on Pritzker.

    And yet…

  41. - Graduated College Student - Friday, May 22, 20 @ 3:49 pm:

If the police and the administration are fighting, I, for one, knee jerk support the state administration, not the cops. I wouldn’t trust law enforcement officers to keep me safe as far as I could throw them.

  42. - Joe Bidenopolous - Friday, May 22, 20 @ 3:57 pm:

=Law enforcement is much more popular than the governor. Always has been, always will be.=

I’d like to see the polling please. I’m certainly not in the pro-cop camp vs JB, and I’m a white male. So if they’ve lost me…

  43. - Eh - Friday, May 22, 20 @ 4:25 pm:

If he does this….than J.B. better not complain about the feds with holding money because of their sanctuary city status…

  44. - Rich Miller - Friday, May 22, 20 @ 4:26 pm:

===feds with holding money because of their sanctuary city status===

What federal law or grant requirement does that violate?

  45. - efudd - Friday, May 22, 20 @ 4:47 pm:

“law enforcement is much more popular than the governor”

Depends on which neighborhood, I guess.

  46. - Huh? - Friday, May 22, 20 @ 4:54 pm:

Local sheriffs and states attorneys are making political decisions to not enforce the Governor’s EO. As a result they are putting the public health of their constituents in danger.

I have voted for county republican candidates because I knew of them before this crisis. They have lost my vote in the next election. Until there is a change of heart by any candidate with a “R” behind their name, my vote is going elsewhere.

With regard to the Governor’s popularity, I like him and what he is doing. The republicants, not so much.

  47. - Yellow Dog Democrat - Friday, May 22, 20 @ 5:24 pm:

Starting under Attorney General Lisa Madigan, the AG’s office started notifying nonprofit organizations that it was withholding state grants from it’s office because said nonprofit had failed to register as required under the Charitable Trust Act with the AG’s office.

Lisa Madigan’s Chief of Staff, Ann Spillane, is now JB’s General Counsel.

Ensuring grantees are following the law isn’t “retaliation,” it is good government.

  48. - Froganon - Friday, May 22, 20 @ 5:47 pm:

My money’s on the Gov in a popularity contest. His polling numbers are high, the vast majority of us support a slow opening up. He hasn’t shot any of the people who pay his salary. My experience with police enforcement makes me skeptical that they command more support than the Gov. The Illinois Sheriff’s Association looked ridiculous with their hysterical opposition to legalzing marijuana.
