Police officers trying to find out who was behind a fake Twitter account set up in the name of Peoria’s mayor have raided a home, seizing computers and phones and hauling several people in to be questioned.

Tuesday’s raid was carried out by four plainclothes officers even though Twitter had suspended the account several weeks ago. Three people at the home were brought to a police station to be interviewed, as were two other people who were met by police at their workplaces.

No arrests were made in connection with the Twitter account, but one of the residents was charged with possession of marijuana, the (Peoria) Journal Star reported. Police Chief Steve Settingsgaard says officers were investigating it as a possible case of impersonating a public official, an offense punishable with a fine of up to $2,500 and up to a year in jail.

The account, @peoriamayor, has been suspended by Twitter administrators. The suspension not only prevents the account holder from using the account to add posts, but it removes all previous Tweets.

* Ironically, a number of new parody accounts for Peoria Mayor Jim Ardis and the police chief have popped up since the story became public. The Peoria Journal Star’s digital editor has compiled a list of some of those accounts.

I’m sure this isn’t the last we have heard of this story.

10:53 a.m. - A Peoria-based writer has a personal interview with the kid behind @peoriamayor. Go and read the whole thing.

When it was active, (Jon) Daniel used it to portray Jim Ardis, the mayor of Peoria, as a weed-smoking, stripper-loving, Midwestern answer to Rob Ford. The account never had more than 50 followers, and Twitter had killed it because it wasn’t clearly marked as a parody. It was a joke, a lark—but it brought the police to Daniel’s door. The cops even took Daniel and one of his housemates in for in-depth questioning—they showed up at their jobs, cuffed them, and confiscated their phones—because of a bunch of Twitter jokes.

Full disclosure: Part of the blame for this situation rests on my shoulders. I loudly promoted @peoriamayor when I first noticed it, having no idea someone I knew was responsible for tweets that mostly had the fake mayor using drugs and partying. It was pretty damn funny. One of Daniel’s roommates told me that the first question police asked him was, “How do you know Justin Glawe?”

“Tell them my name. Tell them I did it,” he said, acknowledging the cops have him cornered. “But when they lock me up tell them to tweet using the hashtag #freesleezyd.”

  6. I have known Mayor Ardis for many years and he is a good man. This is just my opinion but I don’t see the humor in this matter. Someone is pretending to be Mayor Ardis. This is a form of identity theft. Kudos to Jim and the Peoria PD for taking this matter seriously.

    The minute, the second, that Parody and Farce is overtaken by Police Powers and Government edict of what is acceptable in Humor, then why be a free society.

    Food for thought; How many followers do “The Twiiter” have, and now how many more about “The Twitter”, and the trampling of Free Speech by the Chief and the Mayor.

    Incredibly pathetic and sad, and I am sure its under the guise of “protection”…

    I hope at least one good Twitter Parody of the Dopey Peoria Mayor rises and just hammers the Mayor and his Chief Wiggum. I miss @SpeakerMadigan, so I need a good Parody Twitter to read.

    I guess the Peoria authorities didn’t see that coming, either. The incredibly obvious seems to be beyond their grasp these days.

    I find humor in state statement, because you can’t be serious. Were they taking out loans? Getting credit cards? Trying to tap his bank account?

    No, they were making fun of him. They may or may not have been funny.

    What’s not funny is a bunch of cops busting through your front door and grabbing your property, or arresting you at work, because you made fun of a politician.

    That’s scary.

  13. (720 ILCS 5/17-2) (from Ch. 38, par. 17-2) is all about someone misrepresenting as a veteran or public official for profit, gain or to do public harm. Examples of criminal conduct - a bogus fireman taking your child away to do harm. Misrepresenting oneself as a veteran to collect money. The entire statute is along way from protecting the sensitivities of a public servant who has their nose twisted out of joint. Guess that is why no charges filed on the twitter account. Looks like all the search warrant found was a stash of grass left over from a retro “That 70’s Show” party.

    Did Rahm look for the guy? Nope.

    @SpeakerMadigan… were their cried from the Speaker’s Office for the identity? Can’t recall any.

    What makes the Peoria Mayor so special that a Twitter account is something that needs two judges, and and raid?

    If it wasn’t funny, then it ain’t funny. Some parody Twitters stink. A rare few are genius.

    Whoever is advising the Mayor, or whoever is the Flack dealing with the press during this, you should be embarassed that you let such a meaningless Parody get ridiculed and mocked with even more Parody twitters.

    My only hope is that the Mayor has to testify to all this, but you see, there were no charges against the Parody… just like getting your enemies by being a bully, and ignoring the rule of law to do it.

    Who is more pathetic, the Mayor, or the Chief who willfully went about this, using police powers because the mayor is a hot head?

    Parody, and to a lessor extent, satire, are considered a “fair use” of copyright, etc. Further, the Sullivan decision makes it nearly impossible for a public figure to when a libel / slander suit. So, unless this Twitter account did imitations of the classic George Smathers or Lyndon Johnson political smears, the Mayor seems to be over-reaching.

  19. Jeez folks this is simple stuff. Use a VPN. Extremely cheap, military grade encryption, no records kept. It’s bulletproof unless very high up feds want to know who you are, and even then it would take time to crack.

    They’d better pay on this one. The mayor acted like an imbecile, and the police chief behaved like a thug.

    The first order of business is retaining a competent attorney to quash that search warrant - and the resulting findings - asap.

    Thereafter, the PJ Star needs to find its backbone give this mayor and his police chief the storm of grief they deserve.

    This is an absolutely atrocious use of public resources and police power.

    “Police Chief Steve Settingsgaard lost a binder marked “confidential” containing the department’s internal investigation materials near a grocery parking lot in North Peoria, where it was discovered and perused by a citizen. The man, who returned the material to the department, was arrested two days later on major drug charges by officers in the same unit that was the subject of the report.”

  26. This is all about a small time mayor with a small time mindset. The account had already been closed by twitter. A letter from the District Attorney’s office or a phone call to the offending party would have sufficed. 4-7 officers storming the home and going to resident’s place of employment is silly and vindictive all at once. Hauling away computer equipment, phones, etc smacks of a child porn bust, not political satire. I suspect an apology will be forthcoming from the city hoping to avoid a lawsuit.

    I don’t work for Twitter. I was mocking that the Peoria Mayor just couldn’t let it be. I was mocking the idea that like the baby, even getting his “Way” the tamtrum keeps going and going.

    The Mayor just couldn’t let that be it. The Bully, the Mayor, had to make sure that he used Police Powers, and pulling a man out of the shower.

    It appears the Rule of Law, and the Constitution, and Rights of citizens will not get in the way of a whiny/baby Mayor, whose tantrum needed a Police Chief.

    Pathetic way to be about America, democracy, freedom … but a great way to see abuse of power.

    Twitter is a private company that can have any policy it wants.

    Using Police powers, government resources to arrest, search, confiscate, etc HAS NOTHING TO DO with what twitter does.

    If could have a policy that says “We disable any accounts that make fun of religion”… that doesnt make it law, and may be bad policy for their business but will not mean that if my account was disabled under that policy the religious police show up at my door to arrest me and confiscate my phone, computers, and damn XBOX!

  38. For any judge to believe a “fake” twitter account, which by the way could exist in the millions, is somehow “identity theft” under the statute, is frankly sloppy and foolish. This has become a standard way to mock and criticize public officials. As such, you probably cannot even make a reasonable slander case out of it.

    Is that even the judge’s real signature on the warrant?

    I stick with my previous comment, the police should have known better, and the judge should be formally censured.

    Follow the link and you’ll see that the individual in question didn’t use Twitters specific policies (aka lacking legal enforcement) as for their parody account. If they tweak it Twitter will happily reinstate the account.

    Mason explained it well above, but it’s essentially the difference between someone kicking you out of their house and someone calling the police because you’re trespassing. If Twitter finds you breaking the law, they might call the police. If Twitter finds you breaking the rules (which, in this case is just a rule to make sure that people don’t come to a parody account and think it’s the real thing), they might close your account temporarily until the problem is solved. There’s probably some sort of account controls that you can still change after an account has been “closed”.

  73. Mason, I haven’t read that article yet. I read a story-about-the-story, in which the cops say it’s shoddy, the mag says it’s solid.

    Chicago Mag is mostly known for restaurant reviews and covering the social scene. When they undertake any heavy lifting, it’s probably best to judge each article on its own merits.

  90. Highlights from the PJS story filed six hours ago:

    – Mayor Ardis personally ordered the police to track down the tweeter.

    – Police spent “two to three weeks” investigating.

    — Three different judges signed off on warrants. One for Twitter, one for Comcast, one for the raid.

    Add to that we know seven detectives participated in the raid at the house and some of those involved were arrested and cuffed at their workplaces.

    Putin ain’t got nothing on Peoria County. Remind me to steer clear.
