So how exactly does CMS plan to pay a new vendor? Or maybe the RFP will stipulate that the vendor should provide services without charge. Let’s see how many bids they get.

This may qualify for an emergency procurement under the Procurement Code, but such a self-created emergency is not an exemption listed in the 1970 Constitution for having no budget authorization.
This is clearly an expenditure that should be subject to the priorities in a budget. No budget — no vacuuming (ie. situation normal).

This wasn’t competitively bid, they solicited and negotiated with a vendor to come in (in the link)… And yes the vendor should know they aren’t getting paid, probably factored it into their pricing. Interestingly, the term is until mid January which is when everyone seems to think a budget may actually pass (I personally don’t see why January would be any different).

The current vendor quit due to non-payment? The new vendor will want to be paid, too, I would assume. An emergency contract won’t be the solution unless they miraculously come up with a way to start paying for services. Deadbeats.

So a bunch of janitors cleaning an open state building get laid off while a building like the Illinois State Museum is shuttered and those people keep getting paid?

Hasn’t Rauner read the Illinois Constitution? Going back to regular session in January does not relieve the constitutional requirement that an FY 16 budget taking affect July 1, 2015, will require the same amount of votes as today. The FY17 budget can pass in January with a simple majority, but FY16 has no more chance of passing in January than now.

@ Jimmycrackcorn…Unless things have changed since I left, the mid January expiration is likely due to the fact that emergency contracts can be issued for as long as 90 days without a hearing from PPB. After 90 days a hearing is required.

I think if I owned a janitorial business I would charge 3 months of work for 12 months pay. Risk must be mitigated and in business that’s how it’s done. Good job Governor!

That may be the answer. Lock the Governor (and his staff) and the legislators (and their staff) all in the Capitol after making sure the plumbing isn’t working. No one can come in nor levae until they’ve passed and signed a budget.
