* Gov. Rauner was asked yesterday about his plan to end the “subsidies” for school districts under tax caps and within TIF districts…
When communities choose to limit their tax base to fund schools that’s a choice that a local community can make. They’re entitled to make it, they should make it. But when a community chooses to take significant part of its property wealthy and take it off the tax rolls for their schools, that’s a choice, it’s a legitimate choice, but it has consequences. And it’s unfair to all the other taxpayers in this state and all the other communities and school districts in this state to say ‘OK, you took your property out of supporting your schools, so therefore we’re gonna spend a lot more money to send you extra to make up for your choice. That’s not fair to taxpayers, that’s not fair to other school districts that keep all their property tax base for funding their schools. So we need a more equitable system in that regard.
* TIFs are a local choice (approved by the GA), but some of the state’s most populous counties do not have a choice about tax caps…
By state statute, DuPage, Kane, Lake, McHenry, and Will counties became subject to PTELL for the 1991 levy year and Cook County was added for the 1994 levy year. Public Act 89-510 allows county boards to put the issue before the voters by placing a referendum on the ballot. Home rule districts (primarily communities over 25,000 in population) are exempt from the law.
Since 1996, 28 counties have approved PTELL. Nine have voted it down.
* Back to yesterday’s press conference…
GREG HINZ: In dealing with PTELL the way you are, aren’t you effectively busting the state’s property tax law by telling local communities that if they want to get full state aid that they have to go to a referendum that would raise their property taxes? Isn’t that counter to everything you’ve talked about in this?
GOV. RAUNER: No. In fact, just the opposite Greg. It’s exactly what we need to do. What I’ve recommended is that we give, at its core, give local residents the ability to control their own property taxes themselves. This is at the core of what I’ve recommended and it’s part of what we were trying to negotiate with reforms in our budget negotiations. And what we recommended was to do a freeze, for some period of time, 2, 3, 4, 5 years, and, and then give local residents the ability through a simple referendum process, to either raise their total levy, reduce their levy or continue to freeze it, but give the local residents, for their own schools, for their own public safety and issues, to control that themselves. And this, our recommendations are very consistent with that.
HINZ: Alright, but if I can follow up, if a community is property tax capped now, under PTELL, under your amendatory veto to get full state aid wouldn’t they have to raise their property tax?
RAUNER: All the districts, um, are treated the, the same way under the amendatory veto that I’m recommending.
HINZ: It’s still a property tax hike, and you’re supposedly against property tax hikes.
RAUNER: I’m sorry, what we’re, what we’re doing, is allocating state aid for schools. And how a specific community chooses to handle their own property taxes, how they choose to, um, fund their schools themselves, that’s up to them. What we’re recommending is a equitable way to take the state aid, um, and and distribute it across the state in a fair and sustainable way.
Again, lots of counties don’t “choose” to cap property taxes.
And Hinz is right. Under the Rauner AV, in order to avoid a state school funding cut, local school districts under PTELL would have to increase their property tax levies.
This is one bizarre amendatory veto, campers. And it appears directly aimed at CPS.

For gods sake if he just cut ONLY CPS loose from PTELL he could snarl as much as he wanted about black kids getting state money for school or whatever. It makes perfect sense! If he’s adding crazy things in his AV he should at least add something useful.

This framing is a bit deceptive. Communities can choose to raise property taxes above the cap via referendum. Their hands aren’t exactly tied. But the subsidy provides an incentive not to do so. To me the PTELL/TIF stuff seems like extra fluff that should’ve been canned a long time ago. We need to start unwinding this complexity.

I think the Governor has a “fair” point on TIFs. However, terrible idea to impement it retroactively. And an even terribler idea to roll it out in a double-secret AV at the 13th hour.

Madigan really is a genius. He doesn’t have to come out and say much of anything at this point. With all the bumbling, mumbling, and fumbling these legitimate questions from reports, he knows Rauner will continue to self-destruct. I don’t see how people really think Rauner is still continuing to win the media message war. As soon as he opens his mouth at these press conferences (along with other missteps) he loses immediate credibility with folks regardless of his ideological positions.

Come to think of it, it’s more than a little weird Rauner campaigned on a property tax freeze when almost every municipality in the state is already handcuffed on property taxes, much to their own detriment.

And remember that municipalities are the ones that create TIFs. A school district has no say on it. Also many school districts are in multiple municipalities, so residents in the school district in one municipality have absolutely no say if the neighboring municipality creates a TIF in their school district.

Man is the governor in over his head or what? As Hinz pointed out in his column Saturday, his anti-TIF stance puts him and the CTU on the same side. Maybe when he realizes that he’ll change his mind and get his AV pen out again.

I see that Currie filed an amendment to SB 1947 yesterday, appears to be for in event the override fails or the AV is not accepted, but maybe someone out there who has more knowledge than me on these issues.

The AV will be overridden. Like the budget, it’s only a question of how long certain GOP lawmakers will acquiesce with the pain inflicted on their constituents by Rauner and now the IPI. On balance, it will be mostly school districts represented by GOP lawmakers that are forced to close around Thanksgiving and remain closed until enough GOP green lights are gathered for an override. There’s still a very small chance the absurdity of the AV will cause enough GOP to avoid the drama and just override it on the initial vote.

That’s the “new messaging” of the last month. Is the new team so confused, too, that they think he is making sense?
The old superstars had good reasons for desperately trying to keep Rauner on script at all times. He doesn’t know his stuff.
Every press conference now is like Terry Bevington trying to explain making a pitching change when no one was up in the bullpen.

One of the real reasons that Dems are waiting this out is that 71 and 36 aren’t guaranteed, and that Rauner knowing this, a compromise trailer bill to save school funding will need to be carted out, and then that will need 71 and 36.
Rauner hit into a Double Play. The first out (the AV) is the given, the second out (the override or acceptance) isn’t a guaranteed play.
It’s a 1 in 4, and I think I’m probably being “generous”

It is interesting how Rauner uses “community” to lump multiple governing bodies and pretend as though they are one. As pointed out above, no school board chooses to have a TIF.

What’s really unfair is when the state sets up a process (like TIF or PTELL) that removes local control from a school board and then blames the school board for something they had no control over.

Willy, I am pretty confident that the 36 will be there in the Senate. The underlying bill got 35, and the two Dems off were both absent, and they were Haine and Silverstein, who are both going to be a yes. Does that change the odds at all? (I’m not saying it should, getting to 71 in the House is still a heavy lift. But just wondering.)

Deceit was the Governor’s intent:
He campaigned on a phrase that would be popular with ordinarily informed voters. The proposed “property tax freeze” is actually a levy freeze. Yet voters would believe it would freeze their own tax bill at its current dollar amount, which they would love, but which it won’t do by itself. As assessed values decrease over time, because of constant appeals, tax rates have to increase to deliver the frozen levy. So owners would need to appeal regularly and successfully in order to lower their assessed values, so as to offset rising tax rates.

The people who read and post on this site possess understanding and insight well beyond the average voter. Not because they are necessarily smarter but because of their interest which leads to them to be being better informed than the average voter. I wonder how much the average voter pays attention to or cares about this chaos. None of the democrats, including former federal prosecutor Scott Drury, seem to be igniting any enthusiasm among potential voters. Apathy is rampant. Hopefully, before the general election, people will pay attention to these issues. Until that happens, I think Rauner can blunder forward and use television ads to create an image disconnected to reality. He could be the Pet Rock of politics.

The override of AV for SB1 is much more likely than that. Even odds or better. The impact of the 6 retiring Republican representatives in the House will be critically important. Once they are not tied down by ideology to seek reelection, several will realize that many of the possible outcomes for state education funding are a lot worse than SB1, especially for downstate districts.

@pot calling kettle makes an excellent point. No school board wants either PTELL or, especially, TIF.
PTELL is in some ways local albeit county control. Voters act on the ballot question county by county. They usually don’t understand the implications of something this complex but know that it is referred to as “tax caps” which it isn’t. The PTELL offset should be dropped if the formula isn’t changed.
TIF’s are not enacted by popular vote, they are passed by a municipal (city) council vote. One taxing body is taking resources from another. Schools should not be penalized for this. Most fight it very hard. Only one has ever been over turned by the court and that one was in Burr Ridge. Not much light there.
The downstate GOP legislators, at least in our area, are getting hammered on this stuff right now. That said, not seeing them breaking ranks right now.

My brothers had a chemistry set. Just for the heck of it, they began randomly mixing some of the stuff… reminds me of the Governor’s approach to SB1. In my brothers’ case, we ended up with a hole burnt into Mom’s kitchen table. When the true final analysis of the AV is done, we’ll have a better idea of who gets burnt, but I’m thinking it will cover more than the kitchen table.

Trapped, but what does blundering forward even look like in this case? It seems that the Governor has poisoned the well with his AV so that neither an acceptance or an override can pass with the 71/36 votes required. If you vote to override you are for a Chicago bailout; if you vote to accept you may be screwing your own school districts.

Under the old formula, in order to get the maximum amount of state aid, the local school district had to capture all increases in assessed value by increasing the levy to the maximum rate. If they didn’t, their state aid would be reduced accordingly (aka:leaving money on the table). Thus the state was indirectly mandating annual property tax increases. Does SB1 address this issue?

You’re going to have to explain that logic. School districts control neither PTELL or TIFs. Blaming the school district here is odd.
I get the argument about the state having to pick up the slack because units of local government want to divert money away from schools via TIFs, but this AV isn’t the right way to do it. You don’t just throw out an entirely new way of doing business out of the blue without allowing any sort of planning.

CTU are not mayoral loyalists. Where have you been?
And Karen, the teachers, and the union are Bruce’s white whale. That’s what this is all about. It’s not about CPS. It’s not about Chicago. This is all about organized labor and union-busting - the IPI’s libertarian “free market.”

Did you read the first comment which sparked all this? Because, I’m confident that if you did, you probably won’t be making a snarky comment like that.
Want to talk about teachers getting laid off? You know who can solve that problem today? The mayor, just as I’ve been saying in these comments. The mayor controls TIF…a program that brought in $561 million in 2016. 52% of that should have gone to CPS. Think $300 million wouldn’t save those jobs?
As much as I know you love snark (and you do), perhaps you may want to dial it back a touch.

Touche. Guess I won’t take them at their word that they’ll rehire those teachers since they ignored the loss of student population which has reduced money to them from the state.
I know it gets tiresome to hear, but they also don’t rock the boat on TIF ($300 million annually). Gee, I wonder why they wouldn’t do that…

So, yeah…many, if not most, Chicago TIFS are a scam - transfer of taxes/school funds to developers. EDGE transferred taxes to corporations.
Anyone know the history of TIFs in Illinois? Google search not turning up much. Appears to be state law. When and who first introduced them?

It’s state law. Not 100% certain but Chicago was the first in the 1980’s. That district was located in the north Loop. Only expanded from there.
TIFs, however, started in the 1960’s in California.

Not a jab at his personal life, just a notation that if he struggles to recollect/portray his own marriage with no better accuracy, perhaps that isn’t the only inaccurate statement being made.
