* 42 U.S. Code § 247d–6b. Strategic National Stockpile and security countermeasure procurements…
(3) Procedures: The Secretary, in managing the stockpile under paragraph (1), shall—
(A) consult with the working group under section 247d–6(a) of this title and the Public Health Emergency Medical Countermeasures Enterprise established under section 300hh–10a of this title;
(B) ensure that adequate procedures are followed with respect to such stockpile for inventory management and accounting, and for the physical security of the stockpile;
(C) in consultation with Federal, State, and local officials, take into consideration the timing and location of special events, and the availability, deployment, dispensing, and administration of countermeasures; […]
(E) devise plans for effective and timely supply-chain management of the stockpile, in consultation with the Director of the Centers for Disease Control and Prevention, the Assistant Secretary for Preparedness and Response, the Secretary of Transportation, the Secretary of Homeland Security, the Secretary of Veterans Affairs, and the heads of other appropriate Federal agencies; State, local, Tribal, and territorial agencies; and the public and private health care infrastructure, as applicable, taking into account the manufacturing capacity and other available sources of products and appropriate alternatives to supplies in the stockpile; […]
(J) provide assistance, including technical assistance, to maintain and improve State and local public health preparedness capabilities to distribute and dispense medical countermeasures and products from the stockpile, as appropriate.

Jared Kushner said the national stockpile was never meant as a state resource and that it was set up for the feds. And he now has a prominent role in the Coronavirus response. Gives one the warm fuzzies that this is they caliber of person we have at the federal level working on the issue. And we wonder why the feds have completely fallen down on the job.

It’s ridiculous to expect the person appointed by the President to manage the most important health crisis in 100 years to have any actual understanding of the law or qualifications for the job. What are you thinking, Rich?

And yet there are still those that take exception with Pritzker’s “tone” with the federal government.
The efforts of the federal government have not been competent or credible. Governors across the country have every reason to call this out on a daily basis. We’re well past the point of having to pretend that the response has been “perfect” nor should we feel any reason to show “appreciation” to those that have costs thousands of lives through ineptitude.

But what, exactly, is the federal interest, distinct from the interests of state and local government? Are they claiming that the stockpile is only for federal employees? That makes absolutely no sense. The feds answer to the same people the states and locals do: all of us.

Mostly what this statute is laying out is ensuring that State and local public health authorities are sufficiently capable of receiving emergency federal aid as it is available. For example, one does not want a repeat of Hurricane Katrina in Louisiana where there was federal aid available in staging areas but State and local authorities had lost competency to receive it. This sort of problem isn’t really an issue here. Rather, the current problem is that States have depleted their stockpiles, if they had any, and are all at once demanding Federal supplementary assistance that is limited.

There is the law and there is what is done. Sadly, with this administration what is done can change hourly depending on whom it helps. There is a system of checks and balances between the three branches of government. Sadly, that does not seem to exist.

Weird. It’s almost like the stockpile is intended to assist the states when needed, but the President has made it very clear, repeatedly and in exact words that the Feds are “not a shipping clerk.”

So if upstate New York was invaded militarily by Canada, the NY national guard would be in charge of the response, and the US defense department would not be responsible because ….?
