As the state mandated shutdown of Illinois continues because of the Covid-19 pandemic, the Clay County Board met last night at the courthouse in Louisville in a marathon session lasting more than 3 hours.
A crowd of residents about 50 in number attended the meeting in the upstairs courtroom observing social distancing as best they could with family members huddled together. These residents were on hand to voice their opinion about the shutdown and to let elected leaders know they want to get back to work. […]
The major topic of the meeting was a resolution for the board’s consideration calling for the adoption of an alternative plan to open businesses in Illinois rather than the five-phased system enacted by the governor.
Illinois State Representative Darren Bailey addressed the board and the public first and said additional measures will be put forward in the days ahead. Clay County Health Department Administrator Jeff Workman presented his case for the adoption of the resolution to encourage the Illinois Department of Public Health (IDPH) and Governor J.B. Pritzker to consider other options in the push to return to some sort of normalcy. The board also heard from Insurance Broker Bill Atwood, Louisville Stylist Sonja Harrison who just filed her own case against the Governor earlier this week, as well as an impassioned plea from Flora Stylist Stacey Earleywine for the board to take action and Rep. Darren Bailey closed out the argument calling for an end to the governor’s action. […]
Board Chairman Ted Whitehead thanked everyone for attending and for their passion for the cause. Clay County State’s Attorney Andrew Koester spent much of the meeting interpreting the various legal points of the proposed resolution and ones shared from other governmental bodies. When the discussion concluded it was clear that residents who attended wanted the board to approve the resolution put forward by local legislators and regional health departments with the expectation that it be forwarded onto the IDPH and on to Gov. Pritzker. While a motion was made to adopt the resolution, it died for lack of a second. It was also suggested that a subcommittee be formed to study a resolution adopted by the Clark County Board which declared their businesses were free to reopen at their own risk. It’s possible that Chairman Ted Whitehead could call a special meeting in the coming days should another stronger resolution come as a result of the subcommittee’s work. It’s also possible a court ruling against the governor could have major ramifications against his plan and conceivably give local officials more control over their own areas.

Logical Thinker: Have you told your own county board representative that you want your county to open? If not, get on it. Every experiment needs a test case.

Logical Thinker. Unless Clay County has only 50 or so residents, the people who showed up at the meeting are not the sum and substance of the “people”. I am beginning to think your screen name is not intentionally ironic.

I think most elected officials understand that those attending the meeting might be loud, involved, and upset, but they are only a fraction of the population they represent. Most times I’ve seen the “angry guy at the council meeting who gets lots of press” run for local office, they lose badly at the polls.

Oh I get it: the politicians are the ones keeping everyone safe and their actions cannot be questioned because their motives are always pure.
The case counts in Clay County and the vast majority of the state speak for themselves.

A lot of times the loud people in attendance might want something but the board is also listening to lawyers, other experts, and the general feel for the whole community, etc. and decide based on those inputs.

Bailey can bloviate all he wants. But an official vote by an official government body has real significance—beyond bloviation. Congrats to the county board for recognizing their responsibility and potential liability.

I’d like to know what “other options” they are looking at, other than ignoring science and facts. The question raised by Pius - Wednesday, May 13, 20 @ 10:09 am, as to a county board issuing an order that businesses may open, in direct conflict with a State order not to, is another legal question yet to be resolved.

Logical Thinking. Do you actually think that JB or any other politician is doing this to get their jollies? Every day of this shut down just adds to the challenges of governing, but I assume those in charge appreciate that going back to normal poses even greater challenges.

This is the same thing the Madison County Board did last Friday. They put forth a resolution to get the conversation started, then postponed it, formed a committee to work with the states attorney and then came back a few days later and passed it. I’m guessing that’s what Clay County will do as well.

I find it laughable for people to cite the number of people who showed up at a hearing as some evidence of support (or lack thereof) completely oblivious to the hypocrisy these same people espouse when defending the Governor’s mandates. If everyone who agreed showed up (or was allowed to) it would certainly have violated the gatherings mandate and then the commenters would have been in a tizzy about people congregating in large groups. So which is it? 50 people showed up to express there feelings when everyone is locked down (while perhaps putting themselves at risk) or there weren’t enough people?

Your premise is science is directing them.
Do I need to point out where the Texas Governor said in a calm his decision, he knew, would increase the likelihood of more infections.
See, that’s a governor saying “I know the science, but my choice will be this.. and it will leads to more infections or worse.”

Logical Thinker, have no fear. The reopening plan was passed by the Fayette County board last night, by the Shelby County board this morning, and will probably be passed by the Effingham County board later today. Also, a group of Effingham business leaders have sent a letter to the county board requesting the opening of churches.

Where in the Counties Code does it empower counties to supersede state law, which for the time being, is the EO. Home rule could possibly provide such a power (I don’t believe that issue has been litigated) but Cook is the only home rule county in Illinois.
