* A one-vote difference in a 2018 election is still under dispute two years later and heading to trial

A trial to determine who won the 2018 Macon County sheriff race has been delayed to late October.

A Monday court docket entry related to a pre-trial hearing said the parties involved “represent they continue to work on the terms of a partial stipulation as to the disputed ballots.” As a result, Associate Judge Anna Benjamin set a status hearing in the case for Oct. 26, with trial following on Oct. 27 and Oct. 29.

The trial was going to start on Thursday, Oct. 22.

Tony Brown, a Democrat, became sheriff after the initial race led to him being declared winner over GOP challenger Jim Root by one vote. Root then filed for a discovery recount in certain districts.

  2. why doesn’t he just give it up, and run again in 2022, but the time this whole trial is over its going to be time to run for again.

  3. I remember one election where the difference was one vote, but 7 people were later found to have been ineligible. You can’t ask them how they voted because secret ballot, and you can’t have them vote again because that’s voting twice. It was a mess.

    Was that election in Springfield, and if so, was it last year’s Gail Simpson vs. Shawn Gregory for Ward 2?

    Simpson was winning by one vote at election night, but several ballots (including those from the Mary Bryant Home for the Blind) were thrown out for reasons such as assistance in voting, ballot improperly completed, etc. Eventually, it took until last July for Gregory to be determined the winner.

  5. Not sure of the point of going to court. Once an election winner is certified, there’s no going back. Right??

  7. And that is why I make sure to vote early in person if I’m not going to be in town. Doing it in person I get to see the ballot get recorded as it is fed in.

  8. My fishing buddy is Root’s cousin. While fishing, all he does is gripe about politics. Come to find out, he didn’t even vote at all in that election.
