The Champaign-Urbana Public Health District removed the food permit of Apple Dumplin’, 2014 N. High Cross Road, for continuing to serve indoors, but the restaurant continued to operate without the permit, according to health district Administrator Julie Pryde. […]
Earlier Wednesday, Flanigan contended it’s not illegal to serve indoors, and that he believes Gov. J.B. Pritzker would have had to turn to the state Legislature to pass a law banning indoor restaurant and bar service beyond 30 days of the original order back in March.

Apple Dumplin’ restaurant is now under a temporary court order forbidding its continued operation without a valid health permit.
In a hearing Thursday, Judge Benjamin Dyer ruled in favor of the Champaign County Public Health Department — which is staffed and run by the Champaign-Urbana Public Health District — and granted a temporary restraining order prohibiting the restaurant at 2014 N. High Cross Road, U from operating as a food establishment without a health permit. […]
Apple Dumplin’ owners Jim and Kathryn Flaningam had continued to operate their restaurant with indoor service after health district authorities first issued warnings, then revoked the restaurant’s health permit last week. […]
After granting the county’s motion for a temporary restraining order, Dyer also denied a temporary restraining order sought by the Flaningams’ attorney, Thomas DeVore. That was in connection with a separate but related case the Flaningams filed against the Champaign County Public Health Department and Administrator Julie Pryde after their health permit was revoked.
These frivolous, downright harmful lawsuits need to end.

Until the checks stop being cashed by DeVore, these ridiculous lawsuits will continue as long as money is flowing.

The Champaign County State’s Attorney should charge the owners with reckless endangerment. It is a Class A misdemeanor.
Also, someone ought to file a complaint with the ARDC and seek to suspend DeVore’s license to peddle snake oil.

Devore needs to be sanctioned and either have his license suspended or he needs to be disbarred.

I don’t dispute Mr DeVore’s right to vigorously defend his clients, but what he is doing is encouraging businesses to openly violate the law so that he has clients.

Anyone and everyone can file a request for an investigation into the actions of any Illinois attorney here: https://www.iardc.org/howtorequest.html
If nothing else, defending his license to practice law would give Mr. DeVore something else to do with all his time.

What’s the solution when people like DeVore are sitting inside the county health department.
Will county health department not only is refusing to enforce anything, the health department is giving directives that it is ok to run an indoor dining buffet.

For months we’ve talked about Tom DeVore getting sanctions brought against him and Rich continues to post another day another DeVore loss. I remember my Pops saying there’s a sucker on every corner. Well there’s a lot of corners out there and DeVore has the market on them.
The man came right out and said it’s not about winning and people still throw money at him. Where do I sign up for a job like that? I just don’t get it.

This crap of running to court is getting old. The owner was on the local news spewing all the Foxnews Trump propaganda. Called the local public health district “ republic of”. There should be a special place for these folks.

It sure would be a shame if anyone slipped and fell in one of these businesses and filed a lawsuit against them. Without insurance coverage how would they manage?

Or until he is sanctioned by the ARDC. The same applies to the Trump attorneys filing baseless complaints in courts all over the country. If sanctions are not imposed, more and more frivolous and politically motivated suits will be filed.

The picture with the News-Gazette article really says it all about the owners, the husband is not wearing a mask in the courtroom. I feel sorry for their employees, but these are not the kind of people I trust to run restaurants and good riddance to them.

Depending on what county and/or city a business is in determines what kind of action it might face, if any at all, from local government. For the most part across the state they are left alone but for a small handful of counties and cities, the local governments are turning on the small business owner.” - Tom Devore

Devore lost up here in Bloomington, too, in front of the Liquor Commission. Said there was no violation of local liquor laws and the city shouldn’t be involved in enforcing the Gov’s Executive Order.
At least he didn’t argue that the Executive Order was invalid. This time.

Is anybody collecting an easily viewable list of his repeated losses? One that could be referenced whenever people start circulating his name in our comments? Asking for a parody municipality who is finding themselves spending more of their time dragging these chuckleheads than making fun of the real ineptness in Chambana.

I don’t think DeVore is arguing all these cases for the money. It’s to be noticed and for the publicity. It all relates to statewide recognition and a desire for something more.
