A judge in Effingham County has issued a temporary restraining order against the Illinois State Board of Education and reinstated the recognition status of two public schools that aren’t following the governor’s COVID-19 mask mandate.
The case was brought by attorney Thomas DeVore on behalf of Red Hill, Woden-Herrick and Beecher City school districts.
While Red Hill schools were at one point on probation for not having a mask mandate, they complied with ISBE’s mandate and their status was returned to recognized.
“Beecher City and Cowden-Herrick’s recognition status is hereby restored to ‘fully recognized’ instanter [immediately] until such time as the Court has held a preliminary injunction hearing and ruled on the District’s request for a preliminary injunction,” the judge’s order Wednesday says. “The State Superintendent is hereby enjoined from altering the recontamination status of the Districts except as authorized during the annual compliance provisions.”

This illustrates how much as it stake with next year’s Illinois Supreme Court elections.
Just like at the national level, a few bad breaks and we run the risk of having a state high court that upholds radical lower court decisions extremely at odds with the Illinois mainstream.
Maybe Team JB can add this one to the to-do list because there’s little evidence the badly hobbled DPI has the wherewithal.
And perhaps lawmakers should wake up, too. You can pass all the progressive legislation you like, and an extremist court can undo it.

Republicans always say Democrats nominate “activist” judges. Republicans, on the other hand, will nominate “strict constructionists”

Is that how this works? The judge’s order is what changes the status? Seems like sloppy judicial ordering, since I would think the court can only order ISBE to restore the status. I was not aware that the judge has direct access to ISBE systems to make the change.

In other Effingham County news, at least 12 COVID deaths have occurred in the last 10 days. This fact doesn’t seem to be making a ripple around the area, however.
