Puppy lemon law advances

* The puppy lemon law passed the House yesterday 67-49 and now heads back to the Senate for concurrence

The measure’s backers include the Humane Society Veterinary Medical Association, the Puppy Mill Project and Illinois Comptroller Judy Baar Topinka, but several kennel clubs across the state oppose the idea.

Under the plan - which would not apply to breeders or shelters - consumers who purchase an ill or diseased cat or dog from a pet store would have three options: get a new pet, get a full refund or have the store pay for veterinarian treatment.

A licensed veterinarian would have to deem the pet unfit for purchase within 21 days of the sale date, and only pet’s with certain conditions, not including hereditary or congenital diseases, would qualify. Zalewski said 17 other states have similar laws. […]

Illinois now requires pet stores to provide information about a pet’s health history but gives consumers no remedy if they unknowingly buy an ill animal. […]

“We have bills of great importance,” Rep. Mike Bost (R-Murphysboro) said. “Now, I want to let you know how important this is. The office of the governor has come in as a proponent for this. [He] can’t stand up for any other thing we’re doing around here, but the puppy lemon law. You talk about somebody riding issues to the hilt. That’s ridiculous.”

  7. Any indication from Oscar on his position about the Puppy Lemon bill, one bark good- two barks bad? He surely is not a lemon as evident in all his praise and positive and photogenic demeanor but I’d like to get an idea on his thoughts about the issue.

  14. Any sort of heartless humanoid who would return a puppy because it was sick….rather than simply care for the poor dog…..should stand to lose whatever money is invested in the little one.

    Personally, I would be happy to see anyone who would do such a thing be racked and flogged.

    Don’t you know anything about the Soft Coated Wheaton Terrier? Each of those seriously cute fibers you see are DuPont Quallofil (r) and, believe it or not, each piece of fur is its own PFD since it is filled with air. So, worry not.

    I’ve always believed, and will always believe, that puppies who are loved unconditionally can grow up to do some truly amazing things in life–not to mention the joy that they bring to those around them…with just their mere presence.

  20. I’m impressed that Rep. Zalewski got this bill through the House Ag Committee, which has been the killing field for previous puppy lemon law bills. I see most of the opposition came from Republicans and downstate Dems. It’s good to see that Chapa LaVia changed her mind and supported this bill.

  21. Looking at how the members of the House Ag Committee voted on this bill on the floor, there were 11 No votes and just 4 Yes votes, the reversal of the vote in committee.

    Either Zalewski got a whole bunch of regulars substituted, or he persuaded the regulars to vote to let it out of committee with the understanding most would oppose it on the floor. In either case, it’s an impressive feat, given how strongly opposed most of the downstaters are to such laws.

  23. Some thoughts from someone who has been following this closely.

    To the question of who would return a sick dog. There are some diseases which will quickly spread to other dogs, and sometimes humans. Right now, they could happen and a consumer would have no recourse.

    Rep. Zalewski and Sen. Kotowski did a terrific job with this bill. The Humane Society of the United Stated did a fantastic job. They negotiated most of the opposition away and got members like Rep. Rosenthal and Mautino to vote it out of committee. It passed the Senate with one vote.

    Really an outstanding job by Sen. Kotowski, Rep. Zalewski, and Kristen Strawbridge of the Humane Society.

  30. The purpose behind the law is another way to get at the puppy mill problem That along with the pit bull issue are the only reason for too many dogs. So its a serious bill
