This just in… Quinn to appeal stay denial

* 12:01 pm - I’ve confirmed that Gov. Pat Quinn is planning a quick visit to the appellate courts to try to overturn Judge Cohen’s ruling from this morning that denied Quinn a stay on Cohen’s Thursday legislative pay ruling. Quinn wanted the stay during his appeal to the Illinois Supreme Court.

Fasten your seatbelts, campers.

*** UPDATE *** * 12:20 pm - Tribune

“The governor violated the constitution. He had no right to do that despite his benevolent intent,” Cohen said.

Cohen commended Topinka for following his order to “immediately” issue checks.

Testimony showed Topinka will issue checks for October by 3 p.m. today. Quinn attorneys are appealing Cohen’s denial of a stay immediately to the state appellate court.

Quinn’s attorneys argued that “no one in this courtroom” believed Cohen’s decision that the governor violated the constitution “would be the final word in this case.”

  1. Probably will be reviewed on an abuse of discretion standard, which will be difficult for Gov. Quinn — both in his chances of getting the ruling overturned and because he doesn’t seem to know the meaning of “discretion.”

  6. This is just unbelievable. Who’s advising him? Watch for another total smack down in veto session. So he doesn’t get to punish lawmakers that he needs to partner with to govern, he still doesn’t have a pension solution. He has no allies (floor leaders) in either chamber. Pretty soon, this populist grandstanding will show him to be an ineffective governor that can’t pass or kill a bill. Irrelevant. Unbelievable.

  7. 60-40 the Supreme Court ultimately agrees to hear the case. Zero percent that it stays the lower court decision in the meantime. Those are my numbers and I’m sticking with them.

  11. Governor Quinn, give it up already!

    So I think we’ve got the worst possible outcome here -

    1) Quinn appeals, which just ticks off the petulant legislators who won’t finish their pension work until this is settled, for fear of giving him a victory.

    2) Legislators get their paychecks, which gets the public up in arms and gets some of the media to focus again on this instead of other issues.

    Seriously, perhaps getting the IL SC to hear and rule on this farce of Quinn’s will finally bury that tactic so no other gov tries it.

  14. I don’t get it. What is PQ trying to accomplish? I understood the political value of the original veto, but all this extra stuff now is just looking like a temper tantrum. I can’t imagine this is getting him any more votes. It’s probably costing him votes.

  24. Good point by those folks in the courtroom–because as we all expect it’s NOT “the final word,” on this one, although no big Shocker THERE either…still, it’s all quite intriguing drama and “Political Beach Ball Volleyball,” if you will, to watch unFOLD…!

  27. This is like a kid being told no and then throwing a temper tantrum to see if he can get a different answer.

    “I’m sorry Governor, what you did violates the Constitution.”

    Governor: “We’ll see about that. Don’t enforce your ruling until I can ask somebody else.”

    “Governor, I’m sorry but the ruling will be enforced.”

    Governor: “We’ll see about that. I’m going to tell your Dad on you and we’ll see if he says something else.”

You would think that a clearly unconstitutional political stunt that likely has cost Illinois a substantial amount of money might be the kind of thing that would cause voters to look at alternatives come next November, but then you realize that this is Illinois and this stunt and the utter waste of our money is far down the list when it comes to ridiculous stunts and wasting of our money.

    Welcome to fiscally strapped Illinois, where you will do fine, just as long as you are in the business of getting paid to defend the governor, yet again.

  34. Thank you Snucka for showing us all why Quinn is wasting our money for publicity. Of course one could assume that working with the legislature to find a workable solution could be “fighting for the people of IL” No?

    Thank you for reminding us that there are people out there gullible enough to buy the Captain Underpants vs. Everyone narrative out of Pat Quinn.

    After all the Republicans have veto proof majorities and want to make sure there is no Democrat elected right? No legislator proposed any kind of solution until the might Cap. Underpants held back their pay right? After all the legislature is a bunch of bureaucrats who don’t have any “people” to represent right? I mean Capt. Underpants is the only one who is chosen by the voters everyone else just inherited that seat right?

    Here is what seems to be a hard concept for you.

    a. PQ is the DEMOCRATIC gov whose party has a huge majority in both houses. The republicans can do nothing to stop him if he gets a consensus of his party.

    b. Those representative and senators are acting in the interests of the people that elected them. That means they are representing the PEOPLE of their districts.

    c. If PQ can take the pay away from the legislators to get what he wants so can any other gov. So do you want a Gov. Rauner to veto the pay of the legislators in order to close all public schools. (have to make something up because no one knows what he stands for) Let alone what happens if his party can have 40.1% of just one chamber. (FYI that means there is no possible veto override)

  39. If PQ is granted an appeal and loses, he should declare that he will not accept another paycheck until he has paid the state back for the cost of his political grandstanding on this issue.
