The Chicago police department operates an off-the-books interrogation compound, rendering Americans unable to be found by family or attorneys while locked inside what lawyers say is the domestic equivalent of a CIA black site.
The facility, a nondescript warehouse on Chicago’s west side known as Homan Square, has long been the scene of secretive work by special police units. Interviews with local attorneys and one protester who spent the better part of a day shackled in Homan Square describe operations that deny access to basic constitutional rights.
Alleged police practices at Homan Square, according to those familiar with the facility who spoke out to the Guardian after its investigation into Chicago police abuse, include:
* Keeping arrestees out of official booking databases.
* Beating by police, resulting in head wounds.
* Shackling for prolonged periods.
* Denying attorneys access to the “secure” facility.
* Holding people without legal counsel for between 12 and 24 hours, including people as young as 15.At least one man was found unresponsive in a Homan Square “interview room” and later pronounced dead. […]
Unlike a precinct, no one taken to Homan Square is said to be booked. Witnesses, suspects or other Chicagoans who end up inside do not appear to have a public, searchable record entered into a database indicating where they are, as happens when someone is booked at a precinct. Lawyers and relatives insist there is no way of finding their whereabouts. Those lawyers who have attempted to gain access to Homan Square are most often turned away, even as their clients remain in custody inside.
“It’s sort of an open secret among attorneys that regularly make police station visits, this place – if you can’t find a client in the system, odds are they’re there,” said Chicago lawyer Julia Bartmes.

Really? Is this part of some nightmare sequence from Stephen King? What part of the federal version of this did people not pay attention too? If this is legitimate, some reporter should be able to get promoted to Managing Editor for their scoop on this. Letting Rahm, Daley and the rest of the City council ‘leaders’ get away with this unchecked power is anathema to our form of Justice within our borders.

Couple of others have several years experience including it would appear work with the public defenders office…
Also ask your self this question, if you went up to someone in Chicago and told them about this story, would they really be shocked that the CPD might be doing this?

Concerning, yes. May play into a run off if there is one but I’m not sure your average voter will be too bothered when the city is portrayed to be so riddled with violence.
The Guardian erred in leading with this unsympathetic genius as the face of the article. Ordinary people will be likely to react with a “cry me a river” like attitude to a NATO3 rube.

According to Google, this is the Chicago Police Department’s Evidence Vault, 3340 W Fillmore St, Chicago, IL 60624. Likely houses all their crime evidence, drugs, sex assault kits, murder weapons, seized firearms, etc.

This secret facility has police signage a big police parking lot and they hold news conferences there. I have no idea about the allegations but playing this up as a secret off the books facility is dishonest. Every crime reporter in the city has been there when huge drug sweeps happen and they show off all the drugs, weapons & cash.

prety incredible that it took the Guardian to break this - it was a well known location to most criminal defense attorneys and civil rights attorneys for at least the last 15 years or so. If anyone has had a client there or even just driven past it, the anti-terrorism vibe was pretty obvious with a those military vehicles out front

It’s not really all that secret, but the holding pens probably are somewhat secret. Although arrestees cannot be held without formal charges for an unreasonable amount of time, the Constitution does not spell out what this time is. In Illinois, courts use a “totality of the circumstances” test to decide if a person has been held too long. This means that courts will look at many different factors, including:
the length of time a person has been held
how many times their Miranda rights have been read to them, and the conditions in which they are being held. In the situation where the suspect is denied the ability to talk to a lawyer as the Guardian article depicts it increases the possibility the case will get tossed out once and if charges are filed.

The Guardian has been paying a lot of attention to Chicago police brutality the last few months. Last week, they “outed” Richard Zuley, a north side detective who was assigned to GITMO in 2003 and subsequently took over the interrogation of Mohamedou Ould Slahi. Slahi’s best-selling memoir was serialized last month by the Guardian.

Ok it’s not a Black site it’s public. Has signage has marked police vehicles. This is where evidence is stored and retrieved by defendants& victims after the case Is adjudicated. Every police area & detention facility has these allegations. For the to allege it is off the books or secret is blatantly false and dishonest. I’ve heard rumors of a federal government facility downtown with many of the same allegations those in the know call it MCC. Shh. NSA maybe monitoring.

Burge was an area commander. Only bureau chiefs (i.e. chief of detectives) and the superintendent’s office is higher.

As to why it takes the Guardian to “break” the story, it takes a non-Chicagoan to see this for what it is.
In Chicagoese, what has been happening here is that sensitive investigations of dangerous people have been happening in a heightened security environment. Look at what the mother was told when she wanted to write down what was happening to her while she was denied access to her 15-year-old.
It takes someone who hasn’t drunk the Kool-Aid — an out-of-towner — to understand what a black site IS.
Even here, we have people denying that it’s secret because they’ve seen it/been there. Just like everyone knew that GTMO was a military base and Abu Ghraib was a prison, so nothing secret ever happened either of those places?
The Chicago River Denial runs deep.

I can’t help notice the almost complete lacking of any expressions of surprise. When I was a kid, the neighborhood cop was everyone’s friend and usually a community organizer and leader. Now they are more of a military occupation force.

Yeah, I have to say, the BS detector went off pretty hard upon reading this article. Too much over-the-top verbage (’Black-site’, ‘They disappeared us’, etc.). And if it’s an ‘open secret’ among defense attorneys, where they know rampant abuse takes place, why have they not raised the issue, either publicly or with the feds?
That being said, there’s certainly enough there to hopefully warrant a deeper investigation. Lord knows, Chicago PD has a spotty history of operating within the legal rulebook.

Bingo. That is a large facility. They would not place the cages lacking beds or seats in the front lobby.
Posting public hours also has nothing to with failing to book arrestees, beatings, prolonged shackling, denying attorney access, holding kids or dying while in custody.

Well I guess all these lawyers are guilty of malpractice for not filing multie federal lawsuits and demanding a federal investigation. I’m sure the local news reporters are covering this up. This article is beyond over the top. I guess time will tell when nothing is done it will just be part of the conspiracy. An interesting side note no coverage of the big lawsuit against Northwestern for all the lies they told and evidence they faked to try and get offenders out of jail and to coerce a confession of an innocent man.

It’s kind of like you don’t understand how police brutality and criminal defense work.
Each defendant and their lawyer is a frog in a well. Only the system touches each. Only the system has a network.
(except the public defender, but that’s another problem, not a solution)
I mean, have you even heard of the Burge cases?
In many of the most egregious cases, no torture was ever mentioned in any court record.
Why do you think that is?
And why do you think it’s easier,
“now that we’ve fixed that,”
and now that CPD can use magic incantations from the security state to explain its actions in court
to prove that a client’s mistreatment
a) occurred,
b) is against the rules,
c) is a pattern involving other clients in other cases?
And: what makes you think defense lawyers haven’t raised the issue?

I mean, the amount of secrecy we allow CPD is expanding and it’s pretty incredible. It’s part of why they want to wrap themselves in terror plots and talk about any gang average member like they’re a potential mob boss mastermind.
I have personally seen CPD use a Stingray. Now, why do you think it took a single Florida case for this device and its use to come to national attention, when police are probably arresting people illegally right in our own backyard? Because it’s a tinfoil hat story until you find that one judge in a sea of complete ninnies who a) understands the law, b) doesn’t mind making the police mad, c) doesn’t get scared off and back away from security lingo and threats of federales, d) gets offended on their own behalf and on behalf of civil liberties.
You’re not likely to find that judge on the Cook bench. CPD knows this. The SA’s office knows it.

Gotta agreed with Anonymous about the BS detector. If no lawsuits have been filed by Loevy and Loevy - who sue CPD at the drop of a hat - over something going on at Homan Square, then maybe nothing is going on on “Black Site” level the Guardian claims. Something as bad as they claim would not be an “Open Secret” among the Chicago criminal defense bar, not a shy group about raising police misconduct claims. By the way, CPD has districts, not precincts.

Siska: If you’re able to find the location, there are CPD cars there. The evidence-retrieval unit is there. It’s a multi-use facility. People in the department know it exists, but outside people don’t. Maybe not beat officers, but many supervisors know it exists, since they have to work their way through their special units all the time.

Mr. MJM. I get it. You and Rich don’t like the police. Have you been there? I have. It’s the evidence and recovered property section. Hence the secrecy. It’s literally filled with guns and drugs. And yes, a two year defense attorney is a lousy, lousy source. She’s defending secret detainees? Doubtful. The source of this story is the young man who was acquitted of terrorism but was on tape lauding “police on fire.” So believe this drivel if you must. It’s totally false and sourced from questionable souls. You and 47th and Rich, and Word can feel content bashing CPD again.
