* Gov. Rauner told reporters today: “Upholding my amendatory veto requires a simple majority.” Rauner then repeated himself.
The Democrats insist that’s not true. After May 31st, upholding an amendatory veto on a bill that has an immediate effective date requires a three-fifths super-majority, just like any other piece of legislation with immediate effective dates. Click here and scroll to page 9.
So, where did he get that info? It’s a common mistake. Heck, I’ve made it, too. But the governor’s legal counsel certainly knew that answer. Maybe the governor was listening to someone else?
Perhaps he should’ve checked in with the Illinois Policy Institute?…
The General Assembly can agree with the recommendations made by the governor by a simple majority vote in each of the chambers. The bill then becomes law, as amended by the governor. However, should the governor issue the amendatory veto after May 31 and the changes have an immediate effective date, the recommendations require a three-fifths majority vote in both chambers in order to pass. If the effective date is the next fiscal year, the changes only require a simple majority to pass.

The Senate will likely hold a perfunctory session this afternoon at 2 o’clock to get that done, I’m told. Once the bill is “journalized,” the chamber has 15 calendar days to act or the bill dies.

“Bruce Rauner doesn’t understand his own school funding plan, can’t say where his numbers come from, and now doesn’t even know how many votes he needs to pass it,” said Pritzker campaign spokeswoman Jordan Abudayyeh. “This is what happens when a failed governor clings to crisis and surrounds himself with a team of radicals. Illinois schoolchildren should not have to pay the price for this embarrassment in Springfield.”

Here are the relevant Constitutional provisions the Governor and his staff might want to brush up on.
Art 4, Sec 9(e): The Governor may return a bill together with
specific recommendations for change to the house in which it
originated. The bill shall be considered in the same manner
as a vetoed bill but the specific recommendations may be
accepted by a record vote of a majority of the members
elected to each house. Such bill shall be presented again to
the Governor and if he certifies that such acceptance
conforms to his specific recommendations, the bill shall
become law. If he does not so certify, he shall return it as
a vetoed bill to the house in which it originated.
Art IV, Sec 10: …. A bill passed after May 31 shall not become effective prior to June 1 of the next calendar year unless the General Assembly by the vote of three-fifths of the members elected to each house provides for an earlier effective date…..

Regardless of what the Trib may think, this impacts his implementation strategy and is relevant for three reasons 1) Cullerton specifically requested to meet with Rauner prior to his veto to explain the reasoning and this process and Rauner refused the offer, 2) the Democrats asked to negotiate an agreement prior to his veto and he not only declined, he called the idea “outrageous” and 3) when negotiators were delegated from each chamber and each party and some progress was achieved and some, particularly Manar, asked for more time prior to the veto but the Governor insisted on his veto anyway.
Something has to become law in order for schools to get funded whether it’s the acceptance of Rauner’s recommended changes, the override of his veto or some new bill. If the Governor didn’t understand what process was required to get to his desired outcome the relevant question is: does this put his implementation strategy in jeopardy? If so, what then for Illinois schools?

Trump does this kind of thing but it has been 6 months. Rauner? 30 months, plus. There’s no excuse for any governor not to know this detail at this point in their term.
Rauner repeatedly exposes himself as completely unprepared to be a governor of any state, at any time. Heck, Rauner has proved to us that he isn’t prepared to be any kind of leader.
Rauner failed us. He won’t magically improve. He can’t reform Illinois. He can’t do his job. He must go.

The depth of Rauner’s approach to governing is “I’m a rich guy and should get what I want, like I do in every other sphere of my life.” Or, as another rich guy put it some ~400 years ago: L’Etat, c’est moi.
That’s the disconnect with him. He doesn’t learn or engage because of his profound sense of entitlement and disdain for those who are not rich. Wealth is the only barometer of an individual’s worth for him. What is owning 9 homes but an expression of that credo?

The larger issue is why did this occur. Was it because the governor did not know about the 3/5th requirement or didn’t care. My instincts say that it’s the later. If Rauner did care he would have asked someone, anyone, on his staff what happens next after I issue the AV. He’s been threatening to do this for months with a whole host of different staffers providing advice and input. Hard to believe that he’s just know realizing what the rules are.
There’s a parallel here to a President who just in the last week said the Senate should pass health care legislation with a simply majority (when they’re clearly unable to do so). To Rauner and Trump the rules are nothing more than an inconvenience.

All legislators, if not the Governor, are now aware that 36 & 71 are the magic numbers required in support of any bill to distribute state funding this year. Downstate districts will face the cash flow squeeze first, possibly leading to school closings in the Fall. Chicago legislators are fully aware and will wait as long as possible for the prospect of this pain to build. The AV override vote in the Senate is probably going to be held in the middle of August. Perhaps, after the first scheduled state payment to school districts is skipped. Senators need time to gather in Springfield and there is nothing like a bit of drama to highlight the importance of the vote. If AV override is successful in Senate, the override vote in the House will be scheduled around September 1. Several Republicans will support the override because it is not about fiscal restraint. Look to those that have announced that they are not seeking reelection and those representing school districts downstate with very low reserves. Of course, it will be a close vote.

Given the financial squeeze hitting downstate school districts at that point, the downstate legislators will eventually vote for it. The leverage is clear. The Governor ran right into a trap. Rauner vetoes a bill where he gets 90% of what he wants, forces schools to open without funding, just because he thought he could cause disasterous harm on Chicago teacher’s union using an amendatory veto after May 31st on August 1st.
Rauner looked like Elmer Fudd when he realized that instead of cornering Bugs Bunny in a rabbit hole, he trapped himself in a railroad tunnel with a speeding locomotive barrelling down upon him.
Three years. Three years wasted on this sad, sad excuse for a governor.

At this point his people should have told him what’s in SB1. They should have also should have informed him what would happen if he vetoed it and what would happen next. After all they know how government works. Right? I thought it was striking that when the reporter interrupted his third assertion that the AV requires only a simple majority to accept with “the Democrats say…”, he immediately folded his tent. He wasn’t so totally deluded as to believe that they (the Dems) were wrong, and the Superstars were correct. That’s a tacit admission of their and his incompetence.

Ok. So the video doesn’t look good. But to be fair we could have found out months ago that Rauner didn’t know what he was doing but the Democrats chose to sit on this bill. We have to hold them responsible for causing Rauner to delay his impulsive decision. Now we’re talking about Rauner’s lack of governing knowledge when we should be talking about his strengths in blaming Mike Madigan.

–But to be fair we could have found out months ago that Rauner didn’t know what he was doing but the Democrats chose to sit on this bill. We have to hold them responsible for causing Rauner to delay his impulsive decision.–
