Two Illinois Republican state reps are very concerned about the immigration law enforcement measure Illinois Republican Governor Bruce Rauner signed into law Monday.
State Reps. John Cabello (R-Rockford) and David McSweeney (R-Barrington) filed a measure Wednesday that would repeal a new law banning law enforcement in Illinois from stopping persons suspected of being in the U.S. illegally.
“I swore to uphold the U.S. and Illinois Constitutions when I became a legislator,” Cabello told Illinois Review Wednesday. “As a member of law enforcement, I took a vow to uphold the law. I believe and trust in those oaths, and intend to do all I can to keep them.” […]
Only one Republican House member - Bob Pritchard - voted in support of SB 31 on the House floor. Five Republicans - Althoff, McConchie, McConnaughay, Nybo and Radogno - supported it in the Illinois Senate.
Cabello and McSweeney’s repeal bill is HB 4091.
UPDATE 8.31. 2017 - Republican State Senator Kyle McCarter and former sheriff Senator Tim Bivins reportedly have filed an identical bill in the Senate. More to come…
Those aren’t going anywhere, of course, but filing legislation does make them look good to their constituencies.
* Gov. Rauner was asked about GOP legislator criticism about the TRUST Act yesterday, but he refused to answer because, Rauner said, it was an “off-topic” question and he was only taking questions about the school funding bill…
Less than a minute later, however, the governor answered a different off-topic question.

If Cabello thinks this law in any way runs afoul of the State or US Constitution, I dare say he needs a refresher course in Civics. Based on Federal case law, the opposite is true: law enforcement risks violating the Constitution if they *don’t* comply with this Act.

The Illinois law will stand , because Illinois wants to welcome illegals. Anyway, it would be too bad if Trump moves some federal jobs out of downtown Chicago…

For pete’s sake this changes very little. Law enforcement isn’t going out and seeking out illegal immigrants right now for no other reason than they are illegal immigrants. Besides, judges have been pretty clear you can’t stop someone simply to determine if they are illegal.
As for Rep. Cabello, this is the law now. So you are still upholding the law. Does he believe law enforcement officers should get to decide what laws they do and do not uphold?
The anti-immigrant crowd can get themselves all in a frenzy over this bill but it’s a very innocuous bill.

I didn’t know any issues of public policy were “off topic” for any governor.
As for. Rep. Cabello, what other federal civil offenses does he feel qualified and compelled to enforce as a local police officer?
Is he chasing down delinquent taxpayers? Poring over the books at hospitals for Medicare overbilling?
Or does he pick and choose how he upholds his sworn oath?

It’s not about being anti-immigrant: it’s about being anti- illegal immigrant. Does anyone believe it’s alright for 4 million white South Africans to show up to Chicago off a tourist visa and “overstay” ??

Pandering at its very worst. McSweeney is notorious for this type of headline grabbing. He constantly make these types of outrageous assertions. Trying to endear himself to the uninformed. Last message I got, he wanted to file a bill to repeal the budget. How is that working out for you?

Steve, generally I am fine with it. Do South Africans bring with them a patron saint that we can get a state holiday for? Or one that gives us an excsuse to get up at 6:30am, put on green, and start drinking right away?

Overstaying a visa is not a Federal crime, it’s a civil violation. So if anyone is misleading by the adjective they choose (”illegal” or “undocumented”), it’s you.

Cabello apparently doesn’t know what the word “Constitutional” means.
McSweeney is too smart to make such a public statement blunder. He’s against it for policy and political reasons.
