Another day, another lawsuit

A day after Gov. J.B. Pritzker lifted the mask mandate at Illinois schools, a downstate attorney asked an Illinois judge to halt the COVID-19 masking requirement at Chicago Public Schools — one of only a handful of districts in the state still enforcing the practice.

Tom DeVore, who recently launched a bid for the state’s Republican nomination for attorney general, filed a motion Tuesday with Sangamon County Circuit Judge Raylene Grischow requesting a temporary restraining order, arguing the children of Chicago parents who filed a lawsuit against the governor and the Illinois Department of Public Health “are suffering continuing harm.”

“Each is being subjected to wearing a mask as a type of quarantine without being provided” their rights of due process, DeVore said in the motion. […]

The teachers union said the suit is being pushed by someone “trying to leverage the safety and wellbeing of our school communities for his own political gain.”

  1. How exactly can he justify filing a lawsuit in Sangamon County that pertains exclusively to a policy choice by Chicago Public Schools? There’s no statewide school mask mandate any more, so this has nothing to do with state government.

    I doubt many Devore followers and their families attend/attended college so that seems like a misplaced priority.

Not surprising that the public colleges would be the next target, though it appears they only still require them in classroom settings and places governed by contracts or federal law, not dorms, etc. Wrinkle there is the parents can’t sue for students 18+. The students would have to do it themselves.

  6. To Rich’s last point: one would have thought that the events in Ukraine would have made some people re-evaluate their rhetoric, whether it’s the people who claim Chicago is a “war zone” or people who claim political adversaries are tyrants.

    But no. Asking people to take even the smallest bit of action like putting on a mask in a crowded room to help their vulnerable neighbors continues to be characterized as equivalent to being sent to the Gulag. Tell me again that “all lives matter,” though. I really believe that you mean it, Tommy and Richard (Irvin, not Miller).

    Stop. I despise the troll that is Devore as much as the next reasonable person, but there is no need to denigrate people who don’t go to college.

  8. Hold on now. Wait just a minute. Stop the presses. Why is Attorney Tom DeVore filing a new lawsuit? Why isn’t he just filing a motion or something on the previous TRO that the Chicago School parents were part of? I mean he’s been telling everyone that TRO is alive and well and he’s been taking money and adding families to it.

    So why this new starting over with the BIGGEST LAWSUIT ever???
    You think any of those puppets will see that and say anything?

  11. This is a safe lawsuit, right? Sue now that the mask mandate is over, get an established anti-mask judge to say remove the masks, and then wait for the appeals court declare the case moot in a couple weeks when Chicago Schools end the mask mandate of their own will, and according to science.

    It is easy to look important. It is another thing to be important. DeVore is neither. He is a grifter, enriching himself at the expense of the less knowledgeable.

  12. Montrose, I just meant that if they don’t go there what do they care about the mask policy there? My mother and brother did not attend college and are two of the smartest people I know. Try not to immediately assume the worst.

  14. Didn’t this judge in the TRO ruling also say that her ruling did not apply to school districts where the masks were part of a collective bargaining agreement? That would apply to CPS since it was bargained by the union.

    I’m surprised he didn’t file the lawsuit in, say, Edwards County, based on the fact that its boundaries in 1815 included modern-day Chicago. While at the same time making some outlandish claim that Edwards County was “robbed” of their old boundaries.

  18. I see my nine-year-old grandson struggling with grammar in school. Then I read everything DeVore writes and realize, “The kid’s not doing so bad after all.” Perhaps I should sign him up for the July bar exam.

The appellate ruling stated, “We note the language of the TRO in no way restrains school districts from acting independently from the executive orders or the IDPH in creating provisions addressing COVID-19.” I’m not an attorney, but if it’s been made clear school districts could act on their own, where’s the basis for the lawsuit? I know that’s never stopped DeVore before, but at what point does it become filing frivolous litigation?

  21. I’m guessing the lawsuit will be based on a theory that CPS and CTU cannot bargain away someone else’s due process rights. I’m not sure if DeVore realizes quite how big of a bite he’s taking if he goes that route, though.
