* 7:13 p.m. - A motion filed moments ago in St. Clair County Circuit Court by Illinois Attorney General Lisa Madigan requests the dissolution of previous orders allowing payment of regular wages to state employees despite the absent appropriation authority.
Expect updates to come soon including the motion.
…Adding…For those who need a little background: Normally, state agencies send payroll vouchers to the Comptroller citing specific budget lines (appropriations). But when the state started fiscal year 2016 without a budget, the agencies could not send their payroll to the Comptroller. AFSCME filed suit in St. Clair County Court, which ordered state employees be paid even though there were not budget lines for it.
Meanwhile, the Illinois Supreme Court ruled in a lawsuit brought by AFSCME the state did not have to pay raises outlined in the last enacted bargaining agreement because the Legislature did not give state agencies the appropriation authority.
The AG is essentially bringing the higher court’s ruling into the St. Clair Court’s order.
* 7:21 p.m. - From the AG…

* 7:28 p.m. - Attorney General Madigan’s statement…
“Like everyone else in this state, I have long hoped that the Legislature and the Governor would pass and enact a budget. Unfortunately, that has not occurred and an order by the St. Clair County Court has removed much of the urgency for the Legislature and the Governor to act on a budget. However, during this long impasse, the Illinois Supreme Court overruled the sole legal basis for the St. Clair County Court’s order to allow state operations to continue without an appropriation. With a new legislative session now underway, this is an appropriate time to ask the Circuit Court to reconsider this order in light of the changes in the law.”
* 8:42 p.m. - I asked the Attorney General’s Office to elaborate on the timing of this motion. Here’s the response…
It has always been our goal to allow the executive and legislative branches to do their job without further litigation. While the stopgap budget was in place, it was our hope that the Governor and Legislature would continue to work to enact a full fiscal year budget. The Legislature and the Governor now face the need to enact a budget for the rest of the fiscal year. With the legislature in session, this is an appropriate time to address the need to pass a full budget to cover all operations.
* 7:32 p.m. - From Anders Lindall, spokesman for AFSCME Council 31…
We learned of this filing barely an hour ago. We are reviewing the motion and will respond in court.
Despite all the chaos in state government in the past two years, the people of Illinois have been able to count on state employees being on the job to serve them. The last thing Illinois needs is the further instability that blocking state payroll could cause.
Governor Rauner created this hostage situation by refusing to enact a fully funded budget unless his unrelated personal demands were enacted first. He should put aside those demands and do his job to work toward a budget without preconditions. Even so, we are shocked and extremely disappointed that the Attorney General would take this action. It is fundamental that everyone who works must be paid on time and in full, but this filing throws that basic commitment into question for state employees.
* 7:49 p.m. - From the Comptroller…
“Had Governor Rauner met his constitutional duty to propose a balanced budget in 2015 or 2016, we would not be facing a scenario where the livelihoods of our frontline employees could be threatened in this way.”
“Due to Governor Rauner’s abdication of his constitutional executive duties, our state finances continue to be managed almost wholly by court orders and judge edicts. It’s shameful that under his administration, the fifth largest state in the country is forced to operate like a bankrupt business.”
“We do not welcome the prospect of state employees going unpaid. I, like my fellow lawmakers, have been going without a paycheck. The last thing I want is for state employees to join me. I can tell you first-hand how hard I see my employees work. They do not deserve to be used as pawns in a manufactured budget impasse.”
“That said, I will abide by all court rulings as Attorney General Madigan pursues this court action.”
* 8:10 p.m. - From the Illinois Republican Party…
Illinois Republican Party Statement on Madigan Political Court Filing:
“While serious bipartisan negotiations have accelerated in the Senate, it is outrageous that Lisa Madigan tonight decided to put Speaker Madigan’s power politics ahead of hard-working families in an effort to shut down state government. Only a Madigan would try to disrupt bipartisan momentum in a matter that threatens to cripple government services and hurt state workers and their families. Comptroller Mendoza and every Democrat in the state who claims to be independent of the Madigan machine should immediately denounce these tactics and stand on the side of state employees and those who depend on them.”
* 8:25 p.m. - From Catherine Kelly, Gov. Rauner’s spokesperson…
“It’s disappointing to see any move to stop employee pay and disrupt government services, especially now as the Senate is on the verge of a bipartisan agreement to enact a balanced budget with changes to the system. This filing seeks to directly harm thousands of employee families and even more who rely on our dedicated state workers everyday. We urge the Attorney General to reconsider this filing and pledge to do all we can to defend employee pay.”
* 8:53 p.m. - Leader Radogno…
“The legislature has been involved in very public, delicate negotiations. The timing of this action could create an unnecessary crisis that could derail real compromise.”
* 9:26 p.m. - [Posted by Rich Miller, who is back from a speaking engagement in Decatur) Senate President Cullerton’s spokesman in the Sun-Times…
“The Senate president has said that there is an urgent need to have a budget and this would appear to add to that sense of urgency,” spokesman John Patterson said.
* 9:39 p.m. - State Representative Avery Bourne (R-Raymond)…
“The recent court filing from Attorney General Lisa Madigan can only be described as putting politics over people. This politically-motivated action is the same kind of Chicago-style politics that the Madigans too often employ. At a meeting I attended just this morning, a comment was made that, ‘as soon as deals in Illinois are close to done, someone always tries to blow it up.’ While the Senate has been negotiating and making progress towards a bipartisan budget deal, Madigan chose to instead disrupt state employee pay in an attempt to force a shutdown of state government, crippling vital government services and endangering families who rely on them. Attorney General Lisa Madigan should immediately denounce these hardball political tactics and stand with state employees and those who rely on state services.”
* 9:46 p.m. - House GOP Leader Jim Durkin…
The timing of the Attorney General’s action is questionable in light of the current attempts to resolve the budget impasse. This decision clearly undermines the legislature’s duty to negotiate a bipartisan solution

This answer from afscme makes no sense, that is what they want. No need to strike just no pay. This will resolve the problem in no time. It will only be matter of days before some will not be showing up to work. Let’s find out what that means.

This will force some form of a temporary budget is my guess. I am glad she did this as we shouldn’t be continuing without a budget. The debt can’t go up for much longer before we hit the bottom of the funnel.

Only 18 months late with this.
The St. Clair court ruling directly runs against case law (AFSCME v. Netsch, 1991) and has been ripe for an AG appeal since it was issued in the summer of ‘15. Why is Lisa moving now?

AG’s right. Nero#1 Madigan and Nero#2 Rauner clearly have felt no real sense of urgency from the beginning. Public health and social service infrastructures, higher education institutions, etc have been allowed to founder, or are hanging on by some minor/major miracles. Countless vendors are owed money for the whole FY17, because state is so cash poor it can’t process payments even though there was a half-year budget.
Also, if landlord and utility companies had given overdue notices, served eviction or shut off notices to the State like they do for actual people, this would have been over back in early FY16. But who knew it would have dragged on this long?! Something drastically different needs to happen.

It is unfortunate that state employees are the pawns in this fight, and I feel sorry for those families that will now be wondering “what if”, but we need pressure to get a deal, and this could be that pressure.

A little quick on the draw there, Ducky.
Your employer cannot force you to show up for work if they are not paying you.
In fact, if you show up for work and there is no authority to pay you, they should send you home.
As far as unemployment goes, I believe you are eligible for unemployment just as if you had been fired without cause.
Perhaps Anders Lindall can weigh in on that, or someone from IDES.
Complain all we want, but the Attorney General is doing the right thing here. She is sworn to uphold the Constitution, and the Constitution requires an appropriation before the governor can spend money. As she points out in her motion, the St. Clair County circuit erred in its ruling. Was that judge Baricevic, BTW? Sticking his neck out for AFSCME sure did him a lot of good.

@MyNewHandle- I’m suspect there will be another email from JT tomorrow to all state workers that could go one of two ways. Either the “evil democrats are tryin’ to withhold the pay from all you hardworkin’ state workers” and how the administration will fight to make sure we get our pay. Or it could be a la his last email, and say we’re expected to report to work even if there’s no money to pay us, or risk being fired, and the state will pay once there’s an appropriation? Sorry JT….been there, done that, still waiting.

Wow, what timing! This is sure to add pressure to get a budget deal done. This is also sure to sway some AFSCME members that may be on the fence (or against) to vote to authorize a strike. Just budget talks seem to have some movement and then backslide a bit, and just before the planned strike auth. vote.

And whatever Anders. AFSCME striking would probably be an extinction-level event for public employee unions in this state on top of all the other things working against them nationally, so if this move puts off an AFSCME strike then the union is better off having Rauner force a work stoppage based on their being no budget.

Getting hard to distinguish which party hates labor more. Rauner seeks to destroy Collective Bargaining and implement draconian health costs.
Meanwhile Quinn in his own way destroys Collective Bargaining by withholding Contractually obligates pay and raises and them pushes an Unconstitutional Pension Bill. Meanwhile Madigan she of the many Conflicts of Interest seeks to force a budget on back of State employees. Gotta love this State

While this may be true, if CMS, The Comptroller & Treasurer staff are all off the job there’s physically no way to pay staff even if the authority to do so exists.

Well, the AG is on firm legal ground. The Supremes clearly interpret the appropriations clause to mean that there needs to be a legislative appropriations bill in order for state workers to receive a paycheck. I don’t like that decision, but it is the law.
I don’t know about this February 28th stuff though. Who knows how long it will be until a court would actually enforce the motion? It could drag on for a while.
The Illinois Republican Party’s reaction is really patronizing and out of touch. “Only a Madigan…” Give me a break. They can’t just keep saying “because, Madigan” while the state actually falls apart. It’s totally irresponsible. That’s probably the point here. The GA can just send an appropriations bill to Gov. Rauner whenever they want. Then Gov. Rauner would have to actually take some responsibility one way or the other with the bill.

This has been needed since August of 2015. For way, way too long Gov. Gaslight been allowed to hide behind the court order. I understand AFSCME looking out for its members in filing the lawsuit, but the union should have just stood aside and let this play out. It might have had a contact by fall of 2015.

They are asking for pay order to be dissolved effective February 28, 2017 to give time for a budget to be passed. Not sure what paycheck would be affected. Does that mean that a paycheck would be issued for last pay period in February?

As an Afscme member, I’m glad this is happening as it forces a budget of some sort. On the downside, a strike would be more effective if there were no budget in place.

I read the court document. If no budget is signed by 2/28/17 state employees will not be paid therefore non essential employees cannot be required to work. It will cause a shut down of state agencies . I think it’s better than a strike because you won’t have anyone crossing the picket lines.

Oh God this is really going to collapse the workforce. I thought a strike would be bad. Nobody getting paid is worse. So many state workers especially the lower paid ones are paycheck to paycheck. People are going to find other work if they can. Or retire en masse. Holy crap what a horrid mess.

So now ck says we are dedicated state workers who provide needed services. Last week we were overpaid Leeches who were taking money from taxpayers.
This action is needed. Do I want to go without a paycheck? No. Can I afford to? No. But neither could any vendor or medical provider whose 18 months behind getting paid.

Thanks and all due respect to Senators Radogno and Cullerton for finally making an effort to resolve the impasse. But, seriously, Senator? “The timing?” “Unnecessary crisis?” “Derail?” It’s been eighteen freaking months since we had a budget, we’ve been in crisis ever since, and the metaphorical train is at the bottom of a ravine, upside down, and on fire. I can’t say I’m sorry to see the AG bring the hammer down.

Inevitable, appropriate and welcome, after all this time.
Is paying state employees without an appropriation Constitutional or not?
That’s a bedrock question (inevitably, for the Supremes) to answer for Illinois citizens going forward, long after we’ve passed from our current h-a stewardship of our democracy.
For crying out loud, it’s much bigger than a “Bruce and Mike” reality show episode.
The question goes to the foundation of division of powers and governance.

State Employees have to be paid if they work. If they don’t work they can’t get paid. May as well as strike rather than be paid less than a minimum wage worker in Illinois. What choice is left than to strike before a court ruling?

Desert Dweller- there was a court order to pay us before because the comptroller claimed they didn’t have the ability to pay everyone minimum. That’s what I’m talking about.

For those who think that minimum wage is an option, please remember that the 40+ (ancient) payroll systems in this state do not turn on a dime. The “Terminator” governor of California tried to switch his workers to minimum wage also and was told by his computer programmers to “FORGET IT!”

You know a governor is required to submit budgets.
Rauner has left it up to the Legislative, passively derailing anything without his agenda wants.

Seems like this might be a two-fer.
If the motion to pay is dismissed, and the law of the land is no money if no appropriation, that would seem to hurt the last legal action taken by the group of service providers. They were hoping to get paid based on the pay checks being issued with no appropriation.

Roman, again, under FLSA, some workers are owed minimum wage, budget or no. And if NOT paid they get treble damages. While it is lamentable CMS and IOC can’t figure out who is, and is not, required to be paid under FLSA, those funds are due. Or is this the 1950s?

Honeybear, don’t get too worked up until all the facts are known. It’s possible something may be worked out with local credit unions, it’s possible that something will be worked out before 2/28, heck, it’s possible we’ll have a contract because of this (though that may be a pipe dream). The point is, don’t let this news stress you out. Stress will shorten your lifespan and we’re going to have plenty of opportunity to be stressed for the next 4 years already.
Look at the bright side, every day that Trump is in office, there’s less of a chance that Rauner will win in ‘18. See? The bright side.

Follow-up question. By stopping state employee pay, how much in child support won’t be made, and how many people will end up on Public Aid as a result. Child support was one of the reasons John Chiang got was able to defy the California Supreme Court and issues paychecks without a budget. Beuller? Beuller?

Maybe this will push the Governor to submit an actual balanced budget, which includes only a personal income tax increase. Given the budget analysis of the Senate plan, I’m guessing that a balanced budget will require a much higher income tax rate than 4.99%.
We can then hope that the House and Senate to pass their own balanced budgets, pass one and submit to the governor.
I also suspect that neither the governor nor speakers Madigan/Cullerton wants to be the bearer of the honest news, but it will eventually have to be done.

Job descriptions for all positions are on file with CMS. Just because Leslie Munger and Bruce Rauner say something, does not make it true.
I think though that FLSA is a moot point. No employee covered by a collective bargaining agreement can be required to work for free or even for minimum wage. They have a contract, the terms of which are still in effect.

For those that are not aware, Federal Funds are appropriated in the same manner as General Revenue Funds. It does not matter if you are paid from a federal fund or GRF. If there is not an appropriation or a continuing appropriation that applies to you, you will not get paid, if the Court grants the AG’s request.

It’s the ignorance of what’s at play here is why your “decision” to again seemly want things against yourselves is why state labor is where it is today, trying to stay afloat.

No offense but your about to conduct a series of Strike votes. If going without pay because of this is a deal breaker than no one should vote to strike. IMHO this will be over long before a strike would be. This hits everyone in the State Teamsters all of us.
Again No offense I’m not against you or AFSCME but this and a Strike have similar results for the employees in that no work & No Pay. Difference is this is a much larger lever than a strike. There is no blaming greedy state workers on this one. This is on the Gov and to a lesser extent the GA.

I believe Paychecks were delayed a bit due to a budget standoff in the 80’s. The Credit Union offered loans to state employees in the amount of their paychecks until it was resolved.

Lisa Madigan may in fact be helping you in the long run.
As Rich has noted many times, the Governor and his crew have been fighting like mad to keep the pay flowing while, at the same time, refusing to negotiate with AFSCME and trying to force a strike. That would allow him (in his mind and many others) to place blame on AFSCME.
While painful (I really understand that) the halting of compensation put the governor under direct pressure from citizens. Yes, it puts pressure on the legislature as well, but maybe the first real pressure on the governor.
We shall see. But if you look in the mirror you can also see someone else that deserves the blame.

AFSME’s statement is why that union has no credibility. They do not represent their workers near as much as they are just a front for the political elites like the Madigans.

Wow! I hope you’re not my steward. I don’t take ‘instructions’ from anyone on how to vote. And, as OW suggested, you can’t see that if the AG’s motion is granted it will be a far less bitter pill to swallow for AFSCME members than a strike. A partial work stoppage that will be spun as the choice of greedy state workers vs. complete shutdown that Rauner owns.

If you were better than this you’d realize no one statement has said that this move by the AG is illegal, not proper, or without merit for a court to consider.
Do you wonder why they haven’t?
It’s all “Please reconsider”.
So, be better. Understand what’s at play, and look at the move and the responses.
Those with “Madigan!” or in that groove are the least knowledgeable to the moment.

Seriously, I can understand AFSCME wanting its members to get paid, but I also believe that preventing Gov. Gaslight’s ability to hide behind court orders will help in the long run. Roll with it.

Just a reminder- in June 16, we were all instructed to come to work, paid or not. The credit unions and banks started gearing up to loan us money. Then the court order to pay was done.

Cubs 8:52 is spot on. AFSCME and AFSCME employees should be thrilled and relieved by the AGs action. (Should have happened months ago.) Now I suggest cancelling anything related to strike authorization.
