  2. This was a horrible position to be put in.

    Release legal documents and then have to justify the denial of the release of legal documents in the future as being different than this case.

    OR

    Don’t release the documents and take flak for denying a FOIA request.

    Ugh.

  3. So now the AG, current Treasurer, immediate past Treasurer and by association the Speaker are covering up something? Wow! I’m still confused how Rutherford gets to claim this was about preparation for a lawsuit when in fact Braver was hired before any lawsuit existed.

    Thats a taxpayer funded report on a charge of sexual harassment. Rutherford put on a big show about it, and the expectation was that it would be released.

    I dont recall that it was ever billed as a part of his defense. Fredichs should release it.

    For crying out loud, Reagan released the Tower Report on Iran/Contra when Congress and the Justice Department was still all over him.

    But keep this in mind: in the midst of the GOP primary, there was one reporter, Natasha Korecki of the Sun-Times, who just couldn’t help herself but to gay-bait Rutherford with a smarmy, innuendoe-dripping “rooming with a dude” hook story, complete with a Sunday front-page, frolicking- on -the -beach -without- a -shirt photo.

    Subtle, that.

    This was before we all knew that the Sun-Times was walking the street for Rauner, what with the Dave McKinney takedown, the squeeze on Rich Miller, and the ludicrous, singular endorsement.

    The two episodes might not be related, but let’s show all the cards.

  8. Why the angst? The State’s legal counsel says withhold them. You do that until told otherwise by the State’s legal counsel or a judge.

    Frerichs is a glommer.

    Frerichs hard to roll out his employees rights glomming to dove tail Gov. Rauner’s EOs, glomming like a child, “look at me, I sign things too!”

    Meanwhile, the AG decision pertaining to an employee report paid by taxpayers is not being released.

    See, Frerichs just can’t let things unfold, glommers are like that, they have to insert thenselves.

    Well, this is what happens when you sign rules for employees and transparency and you don’t release taxpayer paid reports, under advisement or not.

  11. Don’t promise promise something unless you are sure you can deliver.

    I suspect the Frerichs assumed that he would be able to release the report and that Rutherford did not have cause to retain it. He gets into office and finds out that Rutherford left him with a report he could not share without stepping into legal doo-doo. Rutherford anticipated that his successor would release the report, so he put a legal lock on it.

    Frerichs’s mistake was assuming that Rutherford would not do something to tie his successor’s hands.

  17. Kind of silly not to release the report. The plaintiff in the federal lawsuit has a legal right to the information and will get the report through the discovery process. It is not something they can withhold if their position is something to the effect that it could hurt their case. So, the only people that do not get to see it are the one that paid for it.

  19. If I’m not mistaken, the report was a publicly-funded internal report received in final form well before it was potentially possibly maybe discovery/evidence in pending litigation.
    In other words, it was FOIAble before maybe it wasn’t again.

    Legal advice is just that Mr. Treasurer. Honor your campaign promise, stand tall, and release the report. Lisa will just have to get over it.
