Mautino loses another round

An appeals court last week rejected former state Rep. Frank Mautino’s request to delay the state elections board’s case against him until a federal investigation is completed.

Without comment, the First District Appellate Court in Chicago ruled on the matter Friday, meaning the Board of Elections can resume its inquiry into Mautino’s spending of campaign money.

A board spokesman said Monday his agency would first conduct a status hearing to determine which documents were needed to proceed. Then the board would schedule a hearing for Mautino in which both sides could present testimony and evidence. […]

Last month, Attorney General Lisa Madigan filed a brief with the appeals court, saying she opposed Mautino’s request. She argued the administrative proceedings would put Mautino in a less than ideal situation, but he would not suffer irreparable harm.

“(W)hile a negative inference may be drawn in the proceedings from Mautino’s invocation of his right to remain silent, the state board must prove its case against (him),” Madigan wrote.

  2. How many more months until he gets his pension as Auditor General? Only reason he is still further disgracing Illinois by not resigning in shame. He was a highly respected legislator that ruined it all.

  3. When are federal investigations “completed?” Short of indictments, is there some sort of announcement or something (recent FBI shenanigans at the national level aside)?

    For example, is the NRI investigation completed? The Schock investigation?

    Mautino is asking for an open-ended pass at the state level. No way is that reasonable.

  4. The federal angle on this intrigues me. Since this was a state race I’m assuming it concerns income taxes not paid on money funneled through the car repair shop.

  5. It could be more than income tax. It could be some type of fraud that is covered by federal statute (honest services, mail, wire, etc.)

  6. Our politics aren’t even close, but I’very always liked Frank and thought him a good man. This is a real stain, and I just don’t know why he would want to go out this way.

  7. Maybe he is a good man, but it is a shame when people in power start to think the rules don’t apply to them. It must be fun to spread the wealth around to friends, but it is a slippery slope. Clean living pays off and it is good practice to have someone on your staff to take a hard look at your activities and tell you honestly that you are doing something you might regret.

  11. He’ll have zero pension to save himself with if this blows up really badly and he rings up a felony conviction.

Arthur Anderson - Unless there is something we don’t know, none of the problems are related to his duties as a State Representative or as Auditor General, but rather campaign finance issues, so his pension is not in jeopardy. If he can just hold out to January 1 his salary as Auditor General will be factored into his pension and he’ll be sitting pretty. Look for a resignation letter on January 2.

  14. The whole deal with expenses stinks. The idea that this guy is auditor general stinks worse. Do everybody a favor and resign.

  15. We’ve waited long enough, pot. Frank’s had ample opportunity to explain his campaign spending and has failed to do so. He needs to resign.
