Amends the Illinois Vehicle Code. Provides that no person shall operate or cause to be operated, on a highway, a commercial motor vehicle, with the exception of a highway maintenance vehicle, transporting garbage or refuse unless the tailgate on the vehicle is in good working repair, good operating condition, and closes securely, with a cover or tarpaulin of sufficient size attached so as to prevent any load, residue, or other material from escaping. Provides that a violation of the provisions shall be a petty offense punishable by a fine not to exceed $150 (rather than $250). Provides that a person, firm, or corporation convicted of 4 or more violations within a 12-month period shall be fined an additional amount of $150 for the fourth and each subsequent conviction within the 12-month period. Amends the Criminal and Traffic Assessment Act. In provisions concerning conditional assessments, provides for distribution of a conditional assessment for a violation of the provisions.

The same should apply to gravel haulers. I shudder to estimate the amount of bumper/hood dings and window cracks I’ve received over the years due to stray rocks spewing from the tail/bed of those….
Not from a garbage truck, but I got a $500 dent in the hood of Mrs RNUG’s Eos from a rock off a gravel hauler.

Decatur has a well known garbage problem. Litter generated by the garbage haulers, whether from moving vehicles or from garbage simply not making it into the trucks is but one reason the town looks like it does. You kind of get numb to it. Unfortunately.
It’s still bad but way better than it use to be. 20 years ago you could tell how close to Pontiac you were by the amount of plastic garbage bags stuck to the fences. Closer you got the more there were.
And I agree with the comment about the gravel trucks.
What MrJM said. The trash haulers that drive between Chicago and Pontiac leave a good portion of their cargo all along I-55. I’ve watched it happen on almost every trip I’ve made the Springfield. It clings to the fences. It blows through the fields.

Included should a clause that plastic shrink wrap cannot be used to protect things being transported on an open flatbed trailer. That stuff breaks up in the wind and gets blown to the side of highways.

Yes, but like the other commenters I’ve had more issues with gravel trucks. The dents and cracks are bad enough, but try being behind one on a motorcycle sometime.
Don’t remember any “problems” exactly, but I know I’ve seen things fly off of trucks. Not sure it’s literally garbage trucks though.
I know at least once my dad and I lost a small hay bale on the highway. Left home with 50, got to the guy buying them with 49. We had it tied down, only way we got there with 49 in the bed, one just came loose somehow.
Yes, and while on my motorcycle. I wish the penalties were stiffer, especially for repeat offenders. I also wish it was not limited to only garbage but included other dangerous things like sand, rock, sticks/leaves, etc
Senator Wilcox voted No in committee and didn’t vote on the floor. Seems like an odd bill to oppose.

I am pretty sure this is already against several laws including littering and having secure loads on vehicles. A $150 fine is nothing - they need to be made to clean up twice the amount they dumped.

IL 143 between Edwardsville and Il 255. The problem is so bad that Madison County allocated additional funds to clean up the persistent mess. I would have suggested the States Attorney of Madison County have the police ticket the trucks spreading the garbage and then use the fine money to clean the area.
