*** UPDATED x - Pritzker responds - DGA pounces *** Not a great moment for the governor

Tuesday, Aug 1, 2017 - Posted by Rich Miller

* Gov. Rauner told reporters today: “Upholding my amendatory veto requires a simple majority.” Rauner then repeated himself.

The Democrats insist that’s not true. After May 31st, upholding an amendatory veto on a bill that has an immediate effective date requires a three-fifths super-majority, just like any other piece of legislation with immediate effective dates. Click here and scroll to page 9.

So, where did he get that info? It’s a common mistake. Heck, I’ve made it, too. But the governor’s legal counsel certainly knew that answer. Maybe the governor was listening to someone else?

Perhaps he should’ve checked in with the Illinois Policy Institute?

The General Assembly can agree with the recommendations made by the governor by a simple majority vote in each of the chambers. The bill then becomes law, as amended by the governor. However, should the governor issue the amendatory veto after May 31 and the changes have an immediate effective date, the recommendations require a three-fifths majority vote in both chambers in order to pass. If the effective date is the next fiscal year, the changes only require a simple majority to pass.

They linked to this court case.

* Regardless, check out the video exchange with reporters, particularly during the follow-up questions. Not good…

* So, now what happens? Well, the Senate has to return to session and then enter the veto into its journal. The Senate will likely hold a perfunctory session this afternoon at 2 o’clock to get that done, I’m told. Once the bill is “journalized,” the chamber has 15 calendar days to act or the bill dies.

…Adding… The governor’s office is now admitting that accepting the AV requires a three-fifths vote.

*** UPDATE 1 ***  DGA…

“Today Bruce Rauner soared to new heights of irresponsibility,” said DGA Illinois Communications Director Sam Salustro. “Rauner vetoed a school funding bill for political reasons without even fully understanding the repercussions of his actions. Illinois families were just dragged through a two-year budget crisis exacerbated by Rauner’s veto of the state’s first budget in two years - a crisis was only resolved when Republicans and Democrats joined together to override his veto. Now Bruce Rauner’s failed leadership is putting Illinois schools at risk.”

*** UPDATE 2 *** Pritzker campaign…

“Bruce Rauner doesn’t understand his own school funding plan, can’t say where his numbers come from, and now doesn’t even know how many votes he needs to pass it,” said Pritzker campaign spokeswoman Jordan Abudayyeh. “This is what happens when a failed governor clings to crisis and surrounds himself with a team of radicals. Illinois schoolchildren should not have to pay the price for this embarrassment in Springfield.”

Ouch. That look he gave to reporter.

This governor shouldn’t take questions. he can’t think and chew gum.

This ultimately falls on your chief of staff. She should have flushed this out.

  4. - not again - Tuesday, Aug 1, 17 @ 12:51 pm:

The Governor also referred to this as a concurrence. Again, not the correct terminology for passage of a bill in Illinois.

Someone needs to play School House Rock for Rauner!

  5. - Oswego Willy - Tuesday, Aug 1, 17 @ 12:53 pm:

If the goal of this new Crew was to make Bruce Rauner look like the most uninformed person in the room, and have the press… lecture… Bruce Rauner… on how hapless he is, how ignorant to the constitution he is… how ill-prepared Bruce Rauner is… as a sitting governor.

    “Mission Accomplished”

So, the Governor didn’t take the one IPI staffer that he should have?

  7. - A Jack - Tuesday, Aug 1, 17 @ 12:55 pm:

Fifteen days and then happy Governor’s day, Governor. I am sure if this bill dies you will be getting a warm reception from parents at the fair on August 16.

Whether in Q & A situations or impromtu, the Gov can look quite … bad and uninformed. And this is a conspicuous example of same. #D’oh!

Rauner’s like Trump in so many ways. He is his own worst enemy. I think this fits:

Pride goes before destruction, a haughty spirit before a fall. Proverbs 16:18

  11. - cdog - Tuesday, Aug 1, 17 @ 12:57 pm:

Rather than debating who’s a bigger loser, while still playing this game called “Illinois,” let’s get on with the game.

    Cullerton should call a vote immediately W I T H Rauner’s changes.

  12. - whats a constitution - Tuesday, Aug 1, 17 @ 12:58 pm:

Here are the relevant Constitutional provisions the Governor and his staff might want to brush up on.

Art 4, Sec 9(e): The Governor may return a bill together with
specific recommendations for change to the house in which it
originated. The bill shall be considered in the same manner
as a vetoed bill but the specific recommendations may be
accepted by a record vote of a majority of the members
elected to each house. Such bill shall be presented again to
the Governor and if he certifies that such acceptance
conforms to his specific recommendations, the bill shall
become law. If he does not so certify, he shall return it as
a vetoed bill to the house in which it originated.

Art IV, Sec 10: …. A bill passed after May 31 shall not become effective prior to June 1 of the next calendar year unless the General Assembly by the vote of three-fifths of the members elected to each house provides for an earlier effective date…..

The problem with that is the Governor is trying to play without understanding the rules of the game.

Guy’s getting the worst press he’s gotten since he announced in 2013 and seemingly the most rattled he’s ever been. Though, from all reporting, it seems like the former is probably causing the latter.

  24. - OpenYourEyes - Tuesday, Aug 1, 17 @ 1:15 pm:

I guess it is time to fire his staff and start fresh. Oh Wait…

  25. - The Captain - Tuesday, Aug 1, 17 @ 1:15 pm:

Regardless of what the Trib may think, this impacts his implementation strategy and is relevant for three reasons 1) Cullerton specifically requested to meet with Rauner prior to his veto to explain the reasoning and this process and Rauner refused the offer, 2) the Democrats asked to negotiate an agreement prior to his veto and he not only declined, he called the idea “outrageous” and 3) when negotiators were delegated from each chamber and each party and some progress was achieved and some, particularly Manar, asked for more time prior to the veto but the Governor insisted on his veto anyway.

Something has to become law in order for schools to get funded whether it’s the acceptance of Rauner’s recommended changes, the override of his veto or some new bill. If the Governor didn’t understand what process was required to get to his desired outcome the relevant question is: does this put his implementation strategy in jeopardy? If so, what then for Illinois schools?

  26. - RNUG - Tuesday, Aug 1, 17 @ 1:16 pm:

I’m going to guess they wait 14 days before taking a vote.

  31. - Embarrassing - Tuesday, Aug 1, 17 @ 1:23 pm:

Over the last three weeks, Rauner has moved from a stubborn anti-union ideologue to just looking plain inept and incompetent.

  32. - VanillaMan - Tuesday, Aug 1, 17 @ 1:23 pm:

Trump does this kind of thing but it has been 6 months. Rauner? 30 months, plus. There’s no excuse for any governor not to know this detail at this point in their term.

Rauner repeatedly exposes himself as completely unprepared to be a governor of any state, at any time. Heck, Rauner has proved to us that he isn’t prepared to be any kind of leader.

Rauner failed us. He won’t magically improve. He can’t reform Illinois. He can’t do his job. He must go.

  33. - Union proud - Tuesday, Aug 1, 17 @ 1:25 pm:

You need to excuse the governor. He gets quite emotional sometimes and he just can’t help himself from vetoing things for Chicago school children. Nobody is perfect. /s

If the Governor now agrees that it takes 36 Senators to accept his AV, who are the 14 or 15 non-Chicago Democrats he thinks would ever vote yes to accept, even if he pummels them with the Chicago-bailout cudgel? Maybe a few of the targets vote yes and all the other non-Chicago Democrats just vote present? And if it fails in the Senate, how can he blame Madigan?

    Maybe Edgar was correct after-all!

  42. - Moe Berg - Tuesday, Aug 1, 17 @ 1:38 pm:

The depth of Rauner’s approach to governing is “I’m a rich guy and should get what I want, like I do in every other sphere of my life.” Or, as another rich guy put it some ~400 years ago: L’Etat, c’est moi.

That’s the disconnect with him. He doesn’t learn or engage because of his profound sense of entitlement and disdain for those who are not rich. Wealth is the only barometer of an individual’s worth for him. What is owning 9 homes but an expression of that credo?

  43. - Oswego Willy - Tuesday, Aug 1, 17 @ 1:43 pm:

===“Today Bruce Rauner soared to new heights of irresponsibility,”===

    Giving it a chance… to be oxy-moronic… it’s lacking.

  44. - Soccermom - Tuesday, Aug 1, 17 @ 1:47 pm:

Just so I’m clear — overriding and upholding his AV both require a 3/5 majority. Otherwise, the bill is dead and we start over. Right?

And who is in charge of counting votes for the Governor? (That’s a serious question.)

  45. - wordslinger - Tuesday, Aug 1, 17 @ 1:48 pm:

So the whole strategery was based on getting the basic facts wrong.

Who all signed off on this FUBAR?

Real work and accountability is not nearly as fun as hustling money with shallow partisan talking points.

I wonder how Rauner reacts to being staffed up to look totally clueless as to the fundamentals of his job, live on camera?

  46. - Earnest - Tuesday, Aug 1, 17 @ 1:55 pm:

He likes “winning” to much to bother with that pesky Constitution.

  51. - Pundent - Tuesday, Aug 1, 17 @ 2:12 pm:

The larger issue is why did this occur. Was it because the governor did not know about the 3/5th requirement or didn’t care. My instincts say that it’s the later. If Rauner did care he would have asked someone, anyone, on his staff what happens next after I issue the AV. He’s been threatening to do this for months with a whole host of different staffers providing advice and input. Hard to believe that he’s just know realizing what the rules are.

There’s a parallel here to a President who just in the last week said the Senate should pass health care legislation with a simply majority (when they’re clearly unable to do so). To Rauner and Trump the rules are nothing more than an inconvenience.

  52. - RNUG - Tuesday, Aug 1, 17 @ 2:15 pm:

So Rauner misunderstood. If he was counting on an override to get school funding, it’s not going to happen without GOP votes.

So which GOP House members will be ordered to fall on their sword for Rauner?

  53. - Michelle Flaherty - Tuesday, Aug 1, 17 @ 2:17 pm:

Don’t forget, the governor also said the General Assembly could just pass a new law.
    Yep.
And that would require a 3/5ths vote in the House and Senate.

    This governin’ can be hard.
    Lotto brainwork and remembrin’

  54. - PragmaticR - Tuesday, Aug 1, 17 @ 2:18 pm:

All legislators, if not the Governor, are now aware that 36 & 71 are the magic numbers required in support of any bill to distribute state funding this year. Downstate districts will face the cash flow squeeze first, possibly leading to school closings in the Fall. Chicago legislators are fully aware and will wait as long as possible for the prospect of this pain to build. The AV override vote in the Senate is probably going to be held in the middle of August. Perhaps, after the first scheduled state payment to school districts is skipped. Senators need time to gather in Springfield and there is nothing like a bit of drama to highlight the importance of the vote. If AV override is successful in Senate, the override vote in the House will be scheduled around September 1. Several Republicans will support the override because it is not about fiscal restraint. Look to those that have announced that they are not seeking reelection and those representing school districts downstate with very low reserves. Of course, it will be a close vote.

  55. - Johnny Gianni - Tuesday, Aug 1, 17 @ 2:24 pm:

I loved how sure he was that he was right.

And then how unsure he became when presented with a fact.

And then how wide-eyed he got as he tried to steer clear of acknowledging that this was a deliberate effort to sabotage this bill and blame it on democrats.

  58. - Baloneymous - Tuesday, Aug 1, 17 @ 2:31 pm:

    Michelle,

Great point. Wish same reporter would have mentioned that during presser.

  59. - cdog - Tuesday, Aug 1, 17 @ 2:37 pm:

Will there be a vote allowed to see if the AV can be upheld?

There may be enough Senators that would prefer to just open and fund the schools without all the Democrats’ games.

  60. - Oswego Willy - Tuesday, Aug 1, 17 @ 2:37 pm:

    To the Pritzker Update,

It’s a string continuation of their own messaging that Rauner’s actions reinforce as Rauner failing, and Rauner’s failures.

Like “3 yards and a cloud of dust”

  65. - PragmaticR - Tuesday, Aug 1, 17 @ 3:05 pm:

==Will there be a vote allowed to see if AV can be upheld?==

No. If override fails, Senate leadership will just wait and offer a new bill in October with almost identical terms. Given the financial squeeze hitting downstate school districts at that point, the downstate legislators will eventually vote for it. The leverage is clear. The Governor ran right into a trap. The only way out for Republicans is a vote to override.

  66. - PragmaticR - Tuesday, Aug 1, 17 @ 3:08 pm:

No, there will never be a vote allowed to see if AV can be upheld. If override fails, Senate leadership will just wait and offer a new bill in October with almost identical terms. “I acted exactly quickly”.

Those new Superstars are getting a reamin’.

They sent the Boss out there with all that AV detail that they pulled all-nighters to write.

Only to get the basic vote requirement wrong.

Rauner looked like a surprised deer in headlights when the press informed him of the what the Constitution requires.

So he ignored the question and pivoted to talking points–as in “focus, Amanda, focus”.

Nick Name, radical candor has moved on…..to Twitter

  70. - VanillaMan - Tuesday, Aug 1, 17 @ 3:26 pm:

What a moment we have here, isn’t it?

Rauner vetoes a bill where he gets 90% of what he wants, forces schools to open without funding, just because he thought he could cause disasterous harm on Chicago teacher’s union using an amendatory veto after May 31st on August 1st.

Rauner looked like Elmer Fudd when he realized that instead of cornering Bugs Bunny in a rabbit hole, he trapped himself in a railroad tunnel with a speeding locomotive barrelling down upon him.

Three years. Three years wasted on this sad, sad excuse for a governor.

  71. - Anonymous - Tuesday, Aug 1, 17 @ 3:48 pm:

Rauner’s been given credit for ’staying on message’ like no other. Now it appears he steadfastly stayed on message because if he strayed one iota away, and had to use his brain, things would have gotten mucked up a long time ago.

  72. - Team Warwick - Tuesday, Aug 1, 17 @ 3:49 pm:

If the Governor vetos a bill it takes 3/5.
if he AVs a dollar amount it takes a majority.
    Section 9 Il Constitution.
so it depends on how he did it.

  73. - Ginhouse Tommy - Tuesday, Aug 1, 17 @ 4:13 pm:

At this point his people should have told him what’s in SB1. They should have also should have informed him what would happen if he vetoed it and what would happen next. After all they know how government works. Right? There is no excuse BVR not knowing what is going on and looking that clueless at a major news conference with cameras rolling. He just doesn’t learn or won’t and that’s his problem. These are the kind of mistakes politicians don’t recover from. What a circus.

Rauner best find 71 and 36 quite quick

Deciding to make political hay might not be best… given needs those 71 and 36… so…

I know, President Cullerton tried to warn him…

    “Bruce knows…”

    Knows what? Hmm.

    “And you know what?”

What Governor Rauner, you blew up all of K-12 funding?

    I know.

  76. - Jocko - Tuesday, Aug 1, 17 @ 6:28 pm:

Rauner was simply waiting for some reporter to ask “Who took the strawberries?”

  77. - Igotgotgotgotnotime - Tuesday, Aug 1, 17 @ 6:38 pm:

I thought it was striking that when the reporter interrupted his third assertion that the AV requires only a simple majority to accept with “the Democrats say…”, he immediately folded his tent. He wasn’t so totally deluded as to believe that they (the Dems) were wrong, and the Superstars were correct. That’s a tacit admission of their and his incompetence.

  78. - DuPage Dave - Tuesday, Aug 1, 17 @ 6:54 pm:

Rauner goes from “great question, Dave” happy wrongsplainin’ to deer-in-headlight to steam coming out of his ears in a matter of seconds.

  80. - Pundent - Tuesday, Aug 1, 17 @ 7:25 pm:

Ok. So the video doesn’t look good. But to be fair we could have found out months ago that Rauner didn’t know what he was doing but the Democrats chose to sit on this bill. We have to hold them responsible for causing Rauner to delay his impulsive decision. Now we’re talking about Rauner’s lack of governing knowledge when we should be talking about his strengths in blaming Mike Madigan.
