*** UPDATED x2 - Oberweis won’t concede *** AP calls it for Underwood

Thursday, Nov 12, 2020 - Posted by Rich Miller

* The counting trend was moving away from Sen. Oberweis for days, so this is unsurprising…

*** UPDATE 1 *** US Rep. Underwood…

“I am honored to be reelected to represent Illinois’ beautiful 14th District in Congress. This was a tough race under some very difficult circumstances, and I want to say thank you to my supporters, the voters, and our elections officials for their diligent work.”

“We face urgent challenges as a community and a country. I remain focused on getting results: protecting our families, ensuring a robust economic recovery, and lowering the cost of health care. Whether you voted for me or not, I pledge to represent every member of this community. That’s my responsibility, and I take it seriously. It’s a privilege to bring northern Illinois voices and values to Washington and I can’t wait to build upon all that we’ve accomplished, together.”

*** UPDATE 2 *** Travis Akin, Jim Oberweis Campaign Spokesman…

“The Associated Press calling the race in the 14th Congressional District for Lauren Underwood does not change anything in this race from a legal standpoint. Illinois election law has provisions to allow parties in a closely contested race to seek a recount to ensure that all legal votes are counted and to ensure that the final outcome is the right outcome. There are still votes that have yet to be counted. The totals at this point are unofficial totals as the race has yet to be certified. We are committed to exploring all of the legal options at our disposal and will pursue these options that are afforded our campaign under law.”

…Adding… Here’s a quickie roundup of the recount statutes

Candidate-Initiated Options :

Close vote margin required
Candidate determines how many/which precincts to recount
Contested election

Candidates “nominated, elected, or declared eligible for a runoff election” for any office may petition for a recount. However, a close vote margin is required: candidates must have received “at least 95% of the number of votes cast for any successful candidate for the same office” to be eligible for a recount. 10 ICSL 5/22‑9.1. These recounts are considered “discovery recounts,” and the results are explicitly not binding on the outcome of the election. The statutes require that the results of the examination and count shall not be certified, used to amend or change the abstracts of the votes previously completed, used to deny the successful candidate for the same office his certificate of nomination or election, nor used to change the previously declared result of the vote on a question of public policy.

Neither candidates nor voters may petition to recount precincts “exceeding 25% of the total number of precincts within the jurisdiction of the election authority.” 10 ILCS 5/22-9.1.

As noted above in “Court-Ordered Recounts,” candidates may also initiate a recount through the election contest process, in which the judge overseeing the contest may hold a hearing to determine if a recount is warranted.

For election contests, any candidate on the ballot and any write-in candidate in any election may contest the election. Candidates may also specifically request an “examination of records and equipment” as part of the contest. Unlike “discovery recounts,” the ruling resulting from an election contest is binding upon the election results. 10 ILCS 5/23 1.6a, 5/23 1.2a, 5/23-1.10a, 5/23-26 and 5/23-28.

…Adding… Chairman Madigan…

“We have won a hard-fought victory in the 14th Congressional District, and I extend my congratulations to Congresswoman Underwood. For the last week, Democratic Party of Illinois attorneys and poll watchers have worked side-by-side with State Central Committee members, including Lake County Chair Lauren Beth Gash and McHenry County Chair Kristina Zahorik, and Democratic volunteers to ensure that every vote was counted until this critical victory was final.”

…Adding… I’m told there are no court-ordered recounts for congressional races…

No Illinois court recount. Goes to the Floor of the House.

C. Congressional Office
The Federal Contested Election Act, Pub.L. No. 91-138, 83 Stat. 284 (1969), controls contests for election to federal office. See also the election contest rules for the house involved. Strict pleading requirements apply. H.R.Rep. No. 759, 94th Cong., 1st Sess. (1975); Young v. Mikva, 66 Ill.2d 579, 363 N.E.2d 851, 6 Ill.Dec. 904 (1977).

I guess the cows weren’t home yet for Oberweis

  2. - Oswego Willy - Thursday, Nov 12, 20 @ 2:37 pm:

    First Ives, now Oberweis.

Can the GOP decide that Raunerism (and Trumpkins running) isn’t gonna cut it?

Racist thoughts, with “the old and angry” were on the ballot.

    It lost.

  3. - Chicagonk - Thursday, Nov 12, 20 @ 2:39 pm:

I wonder if this shift will change redistricting.

  4. - Moe Berg - Thursday, Nov 12, 20 @ 2:43 pm:

Thanks for increasing highway speed limits, Chopper Jim.

Sugar Grove Village President better watch his back. Chopper’s got until December 21 to file his petitions for next year’s municipal elections.

How do we get moderate or socially progressive people to win the Republican primary?

  6. - Grandson of Man - Thursday, Nov 12, 20 @ 2:53 pm:

Scaring white collar county residents and suburbanites with looters and rioters who almost certainly will never go to those areas backfired, so excellent news. Congrats to Rep. Underwood.

  7. - Roman - Thursday, Nov 12, 20 @ 2:55 pm:

== I wonder if this shift will change redistricting ==

From a strictly map-making perspective, her Dem congressional neighbors would have been better off if she lost. She’s gonna want more blue leaning precincts and they won’t want to give them up.

  8. - Wow - Thursday, Nov 12, 20 @ 2:57 pm:

You scream, I scream, we ALL scream for ice cream

  9. - Joe Bidenopolous - Thursday, Nov 12, 20 @ 2:57 pm:

=How do we get moderate or socially progressive people to win the Republican primary?=

A good start would be to excise the racism and hatred intrinsic to the party. Oh, and maybe don’t undermine legitimate election results?

    Just a couple of thoughts

== I wonder if this shift will change redistricting ==

Perhaps Rockford (and DeKalb) to Underwood’s 14th; Bustos’ 17th adds Bloomington and Champaign, and 12th and 13th (Bost and Davis) merged?

  11. - Oswego Willy - Thursday, Nov 12, 20 @ 3:01 pm:

    The map “gymnastics” is simple;

Between Krishnamoorthi, Schneider, Casten, Underwood, and Foster… throw in Bustos…

You draw out Miller, let Bost, Davis, and Miller vie for 2 seats…

If you told the Dems in 2009 they’d easily have a 13-4 advantage by mearly drawing out a downstate GOP seat… they’d probably woulda taken that.

  12. - NIU Grad - Thursday, Nov 12, 20 @ 3:07 pm:

“Perhaps Rockford (and DeKalb) to Underwood’s 14th”

The residents of those areas certainly wouldn’t object, especially after years of being mostly ignored by Kinzinger.

  13. - Chatham Resident - Thursday, Nov 12, 20 @ 3:10 pm:

==You draw out Miller, let Bost, Davis, and Miller vie for 2 seats…==

Since they have the least seniority on the House GOP side, would it make more sense to put LaHood and Miller together this time?

Or let not just Bost, Davis, and Miller vie for the 2 seats, but also LaHood?

  14. - Proud Sucker - Thursday, Nov 12, 20 @ 3:19 pm:

    ===beautiful 14th District===

I see what you did there Congresswoman. Touche’

  15. - McGuppin - Thursday, Nov 12, 20 @ 3:21 pm:

I’m guessing the Dems give Kinzinger whatever map he wants and pray he doesn’t run for Governor.

  16. - Boone's is Back - Thursday, Nov 12, 20 @ 3:21 pm:

    Congrats Rep!

  17. - Oswego Willy - Thursday, Nov 12, 20 @ 3:36 pm:

=== Since they have the least seniority on the House GOP side, would it make more sense to put LaHood and Miller together this time?

Or let not just Bost, Davis, and Miller vie for the 2 seats, but also LaHood?===

A contiguous “2 district” downstate pair of seats and forcing Bost and Miller (Further Right members) or Miller and Davis (Davis’ district seemingly the one most vulnerable consistently) why complicate the math?

Kinzinger and LaHood drawnings make Krishnamoorthi, Schneider, Casten, Underwood, Foster, and Bustos seats so much easier to sell.

The downstate two seats is the smart play.

Otherwise others woulda ran against Miller.

Miller can choose to run in LaHood’s seat…like Davis’ or Bost’s… but make downstate, where the easy loss of the Miller seat saves, 14 others.

Plus, the “former Lipinski” seat will be fixed to help that seat too.

  18. - Oswego Willy - Thursday, Nov 12, 20 @ 3:40 pm:

    To the Update x2

Oberweis entered politics with his buffoonery.

Oberweis is leaving with wholly owned buffoonery.

    It’s on brand.

  19. - Chatham Resident - Thursday, Nov 12, 20 @ 3:47 pm:

==I’m guessing the Dems give Kinzinger whatever map he wants and pray he doesn’t run for Governor.==

Perhaps mapped all the way south to be knocking on the door of Dunlap, where I think LaHood is from. Perhaps the likes of Brimfield, Princeville and Chillicothe in Kinzinger’s new 16th? (Unless the remapped 17th gets some of those communities).

  20. - Norseman - Thursday, Nov 12, 20 @ 3:51 pm:

Add another description to the GOP. The party of cry babies.

  21. - Joe Bidenopolous - Thursday, Nov 12, 20 @ 3:55 pm:

    ===pray he doesn’t run for Governor.===

Has Kinzinger said “President-elect Biden” yet? Considering his complicity over the last four years, I don’t think any D is worried about him running

  22. - Ron Burgundy - Thursday, Nov 12, 20 @ 3:56 pm:

The second update reminds me of an old adage, and seems like it is crying over spilt… something… what’s the word I’m looking for?

  23. - Ron Burgundy - Thursday, Nov 12, 20 @ 3:58 pm:

Kinzinger congratulated Biden/Harris 5 days ago via Twitter.

  24. - Oswego Willy - Thursday, Nov 12, 20 @ 4:01 pm:

This idea of “Kinzinger” or “LaHood” being in play ignores what 2009 versus 2022 could be.

    2009 - 12 D, 7 R… 2+ seat swing

    2022 - 13 D, 4 R (if Miller’s district is absorbed by Davis’ and Bost’s)… 4+ swing seat

Securing 13 “Solid D” out of 17 in a map not too confusing to incumbent protection is a huge win.

    No need to overthink it.

  25. - McGuppin - Thursday, Nov 12, 20 @ 4:11 pm:

=== Has Kinzinger said “President-elect Biden” yet? Considering his complicity over the last four years, I don’t think any D is worried about him running ===

    I’m a D and I’m worried about him running.

  26. - Oswego Willy - Thursday, Nov 12, 20 @ 4:13 pm:

Kinzinger has my curiosity… Kinzinger has not got my attention…

    Yet.

  27. - James - Thursday, Nov 12, 20 @ 4:40 pm:

Good for Lauren that she won and that Oberweis won the primary. Rezin may have been harder to beat.

  28. - Oswego Willy - Thursday, Nov 12, 20 @ 4:45 pm:

    Rezin lost… in March.

Until the GOP defeats Raunerites and Trumpkins, it won’t matter to rehash primariles.

Also, Rezin was as much of a Raunerite as Oberweis in the Illinois Senate.

New day, we’ll see how the party sees new beginnings.

  29. - Lincoln Lad - Thursday, Nov 12, 20 @ 6:21 pm:

Happy for Underwood. Can’t wait to see what Oberweis runs for next…

  30. - Soxfan - Thursday, Nov 12, 20 @ 6:37 pm:

    ==Rezin lost… in March.==

And Lauren won… in March. Oberweis winning the GOP primary was, by far, the most important factor in Lauren’s general election victory.

But it’s not all bad news for the ice cream man; he can now run for office closer to home, which is trending R.

  31. - Oswego Willy - Thursday, Nov 12, 20 @ 6:42 pm:

=== he can now run for office closer to home, which is trending R.===

    Florida?

    :)

  32. - Levois J - Thursday, Nov 12, 20 @ 8:19 pm:

Not too surprised Oberweis would call for a recount and following the lead of the POTUS. I have to ask though how many times has he attempted to run for U.S. Congress (Rep or Senate)

  33. - ZC - Thursday, Nov 12, 20 @ 8:49 pm:

Though I refuse to give any GOP Representative credit for … congratulating Joe Biden on his win. Talk about low expectations.
