The charges allege Mapes repeatedly lied to the grand jury during an appearance on March 31 when asked about Madigan’s relationship with his longtime confidante Michael McClain, who has been charged with orchestrating the bribery scheme on behalf of ComEd to win Madigan’s assistance with state legislation.
Mapes lied to the panel even though he’d been granted immunity from prosecution by the U.S. Attorney’s Office and was told by the Chief U.S. District Judge Rebecca Pallmeyer that he must testify truthfully or possibly face criminal charges for perjury, according to the indictment.
The charges against Mapes marked the latest in a still-active investigation that also threatens to ensnare Madigan, who was the nation’s longest-serving state House leader before stepping down in January as pressure from the investigation was mounting.
Madigan has not been charged with wrongdoing.

The indictment is certain to create major ripples in the closing days of the Springfield legislative session, where ComEd and its corporate parent, Exelon, are trying to negotiate a new energy bill before a scheduled Monday adjournment that could include subsidies to keep its nuclear power plant fleet afloat.

The indictment went on to allege that Mapes lied to the grand jury about his knowledge of conversations McClain had in 2018 with two members of the House Democratic caucus, identified only as Public Official B and Public Official C.
The indictment alleges McClain told Mapes about the discussions but doesn’t detail their substance nor allege wrongdoing by those officeholders. WBEZ has confirmed those public officials to be state Rep. Bob Rita, D-Blue Island, and former state Rep. Lou Lang, D-Skokie.
“We have no idea who or what they’re talking about in this,” Rita told WBEZ in a statement Wednesday night. Rita did not respond to a question about whether he’d been asked to testify before a grand jury.
Lang did not respond to a message from WBEZ.

Mapes’ defense attorneys, Andrew Porter and Katie Hill, released a statement denying that Mapes lied to the grand jury.
“Tim Mapes testified truthfully in the grand jury,” they wrote. “His honest recollections — in response to vague and imprecise questions about events that allegedly took place many years ago — simply do not constitute perjury. This case, of course, is not about him — but about the government’s continued pursuit of his former boss. Tim Mapes has in no way engaged in obstruction of justice, and looks forward to prevailing at trial when all of the facts are aired.”

A lot of the people in Madigan’s inner circle always seemed to carry themselves as if they were far smarter than the rest of the world, Mapes especially. The arrogance was often palpable.

Perhaps I read the indictment too quickly, but isn’t there something circular about its reasoning. If McClain was telling people he was doing things at Madigan’s request, but he really wasn’t, and Mapes knew this was just McClain’s bluster, not the truth, Mapes isn’t lying. If he WAS doing things at Madigan’s request, but Mapes didn’t know it or believe it, thinking this was McClain’s bluster, then, again Mapes isn’t lying, he was just wrong. If McClain was doing things at Madigan’s request and Mapes knew it, then he was both lying and awfully stupid. Mapes is many things, but stupid isn’t one of them.
So the only way the Feds can prove Mapes was lying is to prove that McClain was acting as Madigan’s agent. But if they have the evidence to do that, they really don’t need Mapes.

Lots of bashing of Mapes stupidity on the immunity part but it reminds me of the scene in The Godfather when Tom Hagen talks to Frank Pantanglia (sp) before he was ready to testify.

Re-read the Grand Jury Investigation bullets. “whether individual B assisted Public Official A with matters concerning the Illinois House of Representatives….” Mapes said he had no knowledge of this taking place but the indictment says the Feds have Mapes, McClain, Madigan, and Madigan House Staff on calls discussing House business. This indictment is strictly about Mapes lying to the grand jury not about proving McClain was an “agent” for Madigan. The latter is what the Feds will ask Mapes about again and that information/cooperation determines the severity of Mapes punishment and where the investigation goes next.

I have had the same thought re: McClain. These are men in their sixties. They have wives and children and probably grandchildren. What money they have received acting in the Speaker’s behalf will evaporate with the legal fees they are looking at. And prison isn’t a nice place, especially at their age. They have nothing to gain and everything to lose.

It seems to me that the disclosed Q&A reflects questions being asked that the feds already had supporting evidence to prove. This indictment is to pressure for more information about things Mapes has knowledge of but didn’t share or claimed to not remember. They’re still fishing… but not regarding the specific questions documented in the indictment.

Yeah, good guys usually lie to a Grand Jury regarding investigations into briberies of public officials by a utility company benefiting from legislation when the utility company paid a $200 million fine to make it go away.

The feds got a sizzling headline out of Madigan’s former chief of staff indicted for perjury but the indictment’s description of their own investigation just sounds like them saying they are trying to criminalize a lobbyist talking to a politician and Mapes got popped for lying about legal conversations.
I am not a Madigan fan (called for him to resign for years before he did) but I agree with the commenter who said this feels like anything they could try to hit Madigan with based on what is publicly known would just get wiped out on appeal by the McDonnell case.

That’s my whole point. That might be what is explaining why they haven’t indicted MJM yet because what we know about publicly is a weak case under the McDonnell v. U.S. precedent where the Supreme Court practically legalized public corruption unless a prosecutor can show a politician accepting a briefcase of cash on the way to/from a bill signing/vote.

What I find so objectionable is the fact that the Feds had tapes and calling Mapes to testify was not needed. The questions asked Mapes if answered honestly, would in no way incriminate Madigan.
The Feds just wanted to set a trap and hope Mapes would lie. Then they could indict Mapes and squeeze him to testify or “compose testimony” that would hurt Madigan.
