Caulkins loses long-shot US Supreme Court bid on asault weapons ban

Monday, Jan 8, 2024 - Posted by Rich Miller

* Breaking news…

The denial is here.

* React…

* Meanwhile, you may have noticed that Darren Bailey has once again threatened suicide by cop over this topic…

* Here’s Ben Szalinski

Click here for Szalinki’s story.

* Brenden Moore

* The Sun-Times

Only 1% of people with firearm owners identification cards in the state had registered by the deadline, according to the Illinois State Police. Just over 29,000 people reported nearly 69,000 weapons as of Dec. 31, according to the state police. There are 2.5 million FOID holders in Illinois. […]

State police said Thursday the portal remains open, but the agency was vague on the consequences of registering after the deadline, saying the law “does not set forth penalties for late submissions.”

“Decisions on how to enforce PICA will be up to each law enforcement and prosecutorial jurisdiction within Illinois,” a spokeswoman for the state police said in an email to the Sun-Times.

    I don’t know if this is allowed but Darren Bailey is a nut. I really wish he would be arrested although I am sure that he would like that. Maybe he would defend himself and he would then be convicted

  2. - Demoralized - Monday, Jan 8, 24 @ 2:34 pm:

    Nobody is taking your guns you idiot. But have you just admitted you are breaking the law by not registering your guns? I think you should get a nice knock on the door for that. And what you’ve done Mr. Bailey is make a threatening post as well. I’d give you a knock on the door for that one too.

    Same to you Mr. Moore. You’ve stated publicly you are breaking the law. I’d give you a nice knock on the door as well.

    I’m sick to death of these so called “law abiding citizen” gun owners.

  3. - sulla - Monday, Jan 8, 24 @ 2:35 pm:

    You know you’re doing a great job governing when a newly-created law is summarily ignored by 2+ million citizens and 94 out of the 102 county Sheriff offices in the state won’t enforce it.

  4. - Demoralized - Monday, Jan 8, 24 @ 2:37 pm:

    ==is summarily ignored==

    And all of those people bragging about it are despicable people.

  5. - TheInvisibleMan - Monday, Jan 8, 24 @ 2:41 pm:

    –the law “does not set forth penalties for late submissions.”–

    Sure it does.

    If it’s a felony, its 365 in days in jail or more.

    If it’s a misdemeanor, it’s 364 days or less.

    –up to each law enforcement and prosecutorial jurisdiction within Illinois–

    And now we have at least a decade of terrible stories to look forward to about ‘what easily should have been done’, after the next shooting - and there will be. Because it’s not like there’s any consequences for these failed local departments, or that any of them have the integrity to resign due to it.

  6. - Annon'in - Monday, Jan 8, 24 @ 2:50 pm:

    It seems comforting and self confirmin’ when the 2A whack jobs and their mouthpieces announce they want to keep their assault weapons secret. We a draw some circles on the map./

  7. - Cold of Winter - Monday, Jan 8, 24 @ 2:52 pm:

    So you’re saying there is an 84% compliance rate for IL residents?

  8. - northsider (the original) - Monday, Jan 8, 24 @ 3:01 pm:

    Don’t really understand why people who don’t believe in government want to get elected to something.

  9. - Henry Francis - Monday, Jan 8, 24 @ 3:04 pm:

    == a newly-created law is summarily ignored by 2+ million citizens and 94 out of the 102 county Sheriff offices in the state won’t enforce it.==

    So are you saying there are more than 2+ million citizens in the state with assault rifles? For comparison, Pakistan’s armed forces total approx 1.6 million.

    We continue to move from a nation of laws, to a nation of feelings.

  10. - Todd - Monday, Jan 8, 24 @ 3:13 pm:

    I seem to remember a whole bunch of people on here shouting about how the sheriffs don’t get to pick and choose which laws they are going to enforce.

    I see the Sate police saying they are going o ignore the deadline and not enforce that. Did JB say somethng about that??

    oh yea — Sheriffs have a constitutional duty to uphold the laws of the state, not pick and choose which laws they support and when. We’re confident that this law will hold up to any future legal challenges, but again, it is the current law of our state. Anyone who advocates for law, order, and public safety and then refuses to follow the law is in violation of their oath of office,” the governor’s office said.

    I guess the State Police either didn’t get the memo or are exempt.

  11. - fs - Monday, Jan 8, 24 @ 3:14 pm:

    Caulking was arguing that the Illinois Supreme Court decision should be thrown out because two of the justices had a conflict of interest and should’ve recused themselves. Maybe he just doesn’t watch the right cable news channel and missed all the stories about ethics complaints against United States Supreme Court Justices? Because there was absolutely zero chance they were going to take up that issue this year.

  12. - Leap Day William - Monday, Jan 8, 24 @ 3:19 pm:

    That’s just an absolutely terrible grouping by Bailey. However, it does do a perfect job of demonstrating why this type of weapon doesn’t belong in the hands of average citizens.

  13. - Golden - Monday, Jan 8, 24 @ 3:21 pm:

    Thanks, Darren. Now do not having to comply with abortion bans. And, didn’t Justice O’Brien vote for Caulkins’ position? Seems pretty hard to say someone is unconstitutionally biased against you if the vote in your favor.

  14. - Southern - Monday, Jan 8, 24 @ 3:22 pm:

    Regarding the 1% of 2.5 million FOID holders, I think that might be misleading. There are lots and lots of FOID holders who don’t own the types of guns that require registration, correct?

  15. - Brenden Moore - Monday, Jan 8, 24 @ 3:30 pm:

    ==Same to you Mr. Moore. You’ve stated publicly you are breaking the law. I’d give you a nice knock on the door as well.==

    Just to clear up any confusion Demoralized, I’m quoting Rep. Mike Bost in that tweet. When it comes to law breaking, jaywalking and driving a few notches above the speed limit are more my jam.

  16. - Donnie Elgin - Monday, Jan 8, 24 @ 3:52 pm:

    There are lots and lots of FOID holders who don’t own the types of guns that require registration, correct?

    this exactly, and add to that the fact that no one including the ISP knows the identity of, or the raw number of unregistered “assault” weapons. So enforcement would be limited to LEOs pulling someone over for an unrelated offense and happening to find a now-banned weapon in the possession of the suspect.

  17. - JS Mill - Monday, Jan 8, 24 @ 3:52 pm:

    =So are you saying there are more than 2+ million citizens in the state with assault rifles? For comparison, Pakistan’s armed forces total approx 1.6 million.=

    Spot on. MOST people with a FOID do not own a weapon on the list. I have a FOID and CCL and have nothing that requires registration.

    =I seem to remember a whole bunch of people on here shouting about how the sheriffs don’t get to pick and choose which laws they are going to enforce.=

    Ooooh Todd, sick burn. Just so I get this straight, you are cool with people picking and choosing the laws they follow right? I mean you don’t want to be a hypocrite. Right?

    I am willing to bet that there are some laws that you like that I don’t. In a civil society we follow them anyway, but I will let you set the standard here. If you are for law and order I will be too. If not, game on.

  18. - Bruce( no not him) - Monday, Jan 8, 24 @ 3:56 pm:

    I’ve never been a fan of posting online about breaking laws.
    If you’re going to break a law, why put it in writing?

  19. - cermak_rd - Monday, Jan 8, 24 @ 4:00 pm:

    That picture of his guns protecting his jigsaw puzzle is just wrong on so many levels. First of all he has his gun over some of the pieces, so when is he supposed to know when they are needed? My mother’s second husband liked his guns. He displayed them in the living room in a locked case. They were not toys or props to him they were tools.

    This guy looks like a poser.

  20. - MaryHeart - Monday, Jan 8, 24 @ 4:01 pm:

    -Regarding the 1% of 2.5 million FOID holders, I think that might be misleading. There are lots and lots of FOID holders who don’t own the types of guns that require registration, correct?-

    I had this same thought. Last fall I sent my parents a list of guns/gun categories to be reported and asked if my father - a life-long gun owner, FOID holder, and hunter who conscientiously abides by firearms laws - needed any help registering his weapons. I didn’t know if he had any that needed to be registered, and I thought he might. As it turns out, he doesn’t.

  21. - Stephanie Kollmann - Monday, Jan 8, 24 @ 4:12 pm:

    A substantial number of IL FOID card holders are now noncompliant. I estimate several hundred thousand.

  22. - thechampaignlife - Monday, Jan 8, 24 @ 4:16 pm:

    I’m checking in to add to the list myself as another gun owner and FOID holder who has no guns requiring registration. The 1% metric is useless. It is like saying that only a quarter of 1% of Illinoisans have registered their sex offences.

  23. - The Dude - Monday, Jan 8, 24 @ 4:21 pm:

    There is like a 6% rule or something that they believe 6% of Americans own an AR-15.

    That would mean something like of the 12 million people in IL that 660,000 or so would have an AR which is on the banned list.

    So at best 5 to 6 % of people registered.

    Which would likely be one of the most non-compliant instances of citizens not following the law in modern history. Pretty interesting and I’m curious as to how IL moves forward.

  24. - Stephanie Kollmann - Monday, Jan 8, 24 @ 4:24 pm:

    Routinely characterizing the size of the assault weapon register/relinquish problem as small and niche when it is in fact large and wide-ranging does not help to actually implement policy, as it turns out.

  25. - Pundent - Monday, Jan 8, 24 @ 4:27 pm:

    =This guy looks like a poser.=

    Agreed. But he got the jump on Bost which is what he wanted. It’s nothing more than a shameful attempt to keep the base angry over a topic that won’t make a bit of difference for most of them.

  26. - Papa2008 - Monday, Jan 8, 24 @ 4:31 pm:

    I’ve asked this before, with no response, and will ask again: What is the purpose of this registration?

  27. - Rich Miller - Monday, Jan 8, 24 @ 4:32 pm:

    === What is the purpose of this registration? ===

    Because sales are banned. Those with them already must register so the state knows when the guns were purchased.

  28. - Rudy’s teeth - Monday, Jan 8, 24 @ 4:34 pm:

    So Darren Bailey poses with weapons again. Bailey enjoys “show and tell” with his collection of weapons. When Bailey had the chance, did he enlist in the Army, Air Force, Navy, or Marines to serve his country? Anyone, anyone?

  29. - Donnie Elgin - Monday, Jan 8, 24 @ 4:36 pm:

    “So at best 5 to 6 % of people registered. Which would likely be one of the most non-compliant instances of citizens not following the law in modern history.”

    It might be typical based on numbers from a similar ban in NY state…

    https://hudsonvalleyone.com/2016/07/07/massive-noncompliance-with-safe-act/

    That’s a compliance rate of about 4 percent. Capanna said that the high rate of noncompliance with the law could only be interpreted as a large-scale civil disobedience, given the high level of interest and concern about the law on the part of gun owners.

  30. - Dotnonymous x - Monday, Jan 8, 24 @ 4:41 pm:

    Bailey seems addicted to the attention he continues to seek…so desperately.

    His repeated threats around violent death are concerning.

  31. - Dotnonymous x - Monday, Jan 8, 24 @ 4:47 pm:

    “I’ll be here putting together this puzzle waiting for Pritzker to knock on my door and take my guns.” - Darren Bailey

    Is that a death threat?

    Has Bailey’s cheese slid off of his cracker…yet further?

  32. - JS Mill - Monday, Jan 8, 24 @ 4:50 pm:

    =That was an act of civil disobedience against a law you did not agree with?=

    No, it was breaking the law and many paid the price. In this instance, buffoons like Bailey think it is ok and don’t believe they should suffer consequences for their actions.

    Bailey is both a stereotype and joke at the same time. He wants to play dress up army man and act like he is tough. But, when he had the chance he passed on military service. Not sure what he spent his time on, but it wasn’t diction lessons.

  33. - Robert Montgomery - Monday, Jan 8, 24 @ 4:56 pm:

    That poor tree.

  34. - Rudy’s teeth - Monday, Jan 8, 24 @ 5:02 pm:

    As Bailey grins like a Cheshire Cat while posing with weapons, he is nothing more than a charlatan.

    Bailey’s place is on his porch and not in Congress.

  35. - Dotnonymous x - Monday, Jan 8, 24 @ 5:09 pm:

    I believe Darren Bailey typifies many other Trump lovin’ insurrectionists…tough as nails, while on their comfortable porch.

  36. - FormerParatrooper - Monday, Jan 8, 24 @ 5:39 pm:

    JS Mill, I do expect they know they can be held accountable and probably have a contingency plan if they are arrested that does not involve a shoot out with police. Being arrested is possibly what is wanted in order to have standing in a court case challenging the law at another angle.

    As far as his lack of service, I am not sure what that has to do with anything. I served, proudly so, and I owned a few weapons that are now banned. Hopefully that does not place me in the same level of contempt you have for others.

  37. - Rich Miller - Monday, Jan 8, 24 @ 5:41 pm:

    ===probably have a contingency plan if they are arrested that does not involve a shoot out with police===

    Bailey has said he won’t be taken alive. “Like I’ve said many times, I’ll die on my porch before I give up my guns”

  38. - FormerParatrooper - Monday, Jan 8, 24 @ 5:53 pm:

    Rich I think it is bravado, I know too many people like him.

    First, I hope you are feeling better.

    Second, have you ever spoken to Bailey individually? If you have some experience with him one on one with his political ideology, you would be in a much position to know if he is being serious with that statement. I can only judge from what I have seen by people and by what little I know of him

  39. - Rich Miller - Monday, Jan 8, 24 @ 5:54 pm:

    ===Rich I think it is bravado===

    He has said this many, many times.

    ===Second, have you ever spoken to Bailey individually?===

    Quite a few times.

  40. - Rich Miller - Monday, Jan 8, 24 @ 6:01 pm:

    ===First, I hope you are feeling better.===

    Thanks. I think I may have turned a corner.

  41. - FormerParatrooper - Monday, Jan 8, 24 @ 6:03 pm:

    Rich, I take it you believe him then. I feel I can trust your assessment.

    Let us hope it is bravado, I pray it is.

  42. - FormerParatrooper - Monday, Jan 8, 24 @ 6:06 pm:

    =====Thanks. I think I may have turned a corner.====

    Good. I am glad to hear that.

    Southern, JS,

    take a look at my vid I just did crunching some numbers

    https://youtu.be/vB-BTlJBotM

    two polls from 2021 and 2022 say ARs are owned by 20-3% of gun owners. but there are more numbers like the FTIPs

  46. - Stephanie Kollmann - Monday, Jan 8, 24 @ 7:40 pm:

    Did you register yours, Todd?

  47. - Todd - Monday, Jan 8, 24 @ 7:48 pm:

    NOPE not a one. Not my light saber, not one pistol, shotgun or rifle.

  48. - Anyone Remember - Monday, Jan 8, 24 @ 8:00 pm:

    ===NOPE not a one.===

    Law abiding?

  49. - JS Mill - Monday, Jan 8, 24 @ 8:24 pm:

    =So enforcement would be limited to LEOs pulling someone over for an unrelated offense and happening to find a now-banned weapon in the possession of the suspect.=

    Or grinning idiots that pose with their…let’s call them “weapons”, but for Bailey it may be a stand in for something else.

    =As far as his lack of service=

    I was referring to Bailey and his ilk. The guys who never served (I didn’t either and don’t p[lay army man dress up). My contempt is for them. Hopefully the ISP is planning their visit to Bailey’s house given his confession.

    =NOPE not a one.=

    Which makes you a criminal.

  50. - Big Dipper - Monday, Jan 8, 24 @ 8:46 pm:

    When Bailey shoots himself in the big toe I hope it takes a long time for the ambulance to get to his bunker.

  51. - Big Dipper - Monday, Jan 8, 24 @ 8:55 pm:

    It’s pretty funny that the State thought so little of Caulkins’ cert petition that it waived filing a response. And SCOTUS thought so little of it that it didn’t ask for one.

  52. - Todd - Monday, Jan 8, 24 @ 9:19 pm:

    Anyone — don’t care anymore how you define that

    I’ve complied with their BS up to this point not giving them anymore they cant get their rules straight cant write an explanation of what certain common terms mean so as to unduck the mess they have

    JS — the gov can’t get his own agency to follow the rhetoric he laid down but I’ll play game on. Now stack up or step off

  53. - Anyone Remember - Monday, Jan 8, 24 @ 9:21 pm:

    “… they cant get their rules straight cant write an explanation of what certain common terms mean so as to unduck the mess they have … .”

    Pretty accurate description of the whole JCAR process for everything.

  54. - Candy Dogood - Monday, Jan 8, 24 @ 9:54 pm:

    So, this idiot is either shooting up a tree in his front yard when he has access to literally thousands of acres of land or this idiot is pretending to shoot a tree in his front yard and editing a really closely cropped video of a tree getting shot so that it just looks like he’s dumb enough to damage a nice tree in his front yard.

    I don’t care what your political leanings are, that kind of stupidity is cause for divorce.

  55. - JS Mill - Monday, Jan 8, 24 @ 10:07 pm:

    =Now stack up or step off=

    What? Sorry, whatever code you are speaking I don’t understand.

    The law speaks for itself, you chose to break it. You word means nothing as it pertains to matters of the law given your confession. Moral relativism is the path little kids often follow, we do try to be adults here so arguments like “but Jimmy doesn’t have to go to bed now” are pretty sad.

  56. - Donnie Elgin - Monday, Jan 8, 24 @ 10:22 pm:

    Todd

    Enjoyed the video - prayers for your wife in recovery from stroke - Rush hospital is great.

  57. - Todd - Tuesday, Jan 9, 24 @ 8:01 am:

    JS –
    just like a lot of people decided not to follow the law when it came to pot, a lot of people are fed up with Illinois gun laws. Other groups choose to not follow laws, say blocking road ways and expressways for their civil disobedience and this is just an extension of that. It’s not about what aboutism it’s simply a large number of people have said enough.

    I know several people who registered things, some had short barreled rifle already in the NFA registry so it didn’t matter. Some have jobs with licenses that a criminal charge could jeopardize their livelyhood.

    us gun owners have been checked and rechecked with background checks and FOID cards. so we’re not the “criminal class” causing the mayhem in the streets of Chicago. But Pritzker & co and yall think we are the problem — so be it.

    first offense is a misdemeanor IF you get arrested and IF you get charged. No cash bail so i and others are willing to roll with that

    cheers
