A mixed bag for lame duck session

* Those who worry about lame ducks getting too far out of control should look at the medical marijuana bill, which came up way short yesterday afternoon in the House. The bill needed 60 votes, but when all was said and done it got 53

After nearly two hours of sometimes passionate debate, the measure fell just a handful of votes short of the 60 needed to advance to the Senate, which must approve changes made in the House before it can go to Gov. Pat Quinn’s desk.

Under the legislation, certain patients could obtain medical-grade marijuana from state-regulated dealers for use in their homes.

Patients would have to receive permission from a physician to apply for a license. The Illinois Department of Public Health would then authorize the person to obtain three marijuana plants per month.

All of you know where I stand on this issue. I’m not sure this is the greatest bill in the world, however. Three plants per month seems a bit much. Not that I would know anything about that, of course.

* And then there was the death penalty abolition bill, which wasn’t called for a floor vote yesterday for lack of support

A House committee [yesterday] morning voted to abolish the state’s death penalty, after a contentious debate, with critics alleging the bill was being rushed through the Legislature for political reasons.

The measure could come to a House floor vote as early as [yesterday] afternoon. “I’m still counting votes. [Monday] night we had 58,'’ said the sponsor, state Rep. Karen Yarbrough, D-Broadview. It needs 60 for House passage, and then would move to the Senate.

The House is losing some members today, so it’s fate, as they say, remains uncertain.

* Some other big stuff did pass, however. The Tenaska folks won the House round, but they have a tough fight ahead in the Senate

The $3.5-billion “clean coal” power plant that has been the subject of a fierce lobbying war in Springfield between labor and business interests was approved on a second vote late Tuesday in the Illinois state House of Representatives.

The bill, which would require Illinois ratepayers and business users of electricity to purchase the Downstate Taylorville power plant’s output for 30 years, initially was narrowly defeated Tuesday and then was held, allowing Speaker Michael Madigan to call it for another vote later.

The Tenaska bill passed 63-50 on the second vote, after having lost by two votes the first time around.

Some lawmakers said on the floor that the second vote for the clean coal plant Downstate was a trade for the vote earlier in the day in favor of a $3-billion synthetic gas plant on Chicago’s South Side.

Subscribers know the rest of that interesting little story.

* And some sweeping changes were approved for police and firefighter pension funds in the House yesterday without much debate

— Changes the standard retirement age for police and firefighters from age 50 to age 55. Police and firefighters could retire early starting at age 50, but would lose 6 percent for each year before 55.

– Reduces benefits to a surviving spouse from 100 percent to 67 percent of the deceased police officer’s or firefighter’s pension.

– Cost of living increases — the lesser of 3 percent or one-half of the urban consumer price index — would not kick in until a public safety employee or surviving spouse reach age 60.

– Starting in 2015, pension funds could petition the state comptroller to subtract funds from tax money owed to the cities by the state if a city does not make complete payments to the system.

* The bill received a whopping 95 votes, even though it was hotly opposed by Mayor Daley, who sent his chief legislative liaison to town yesterday…

The bill established a steep yearly payment schedule for Chicago to restore the city’s underfunded police and fire retirement funds to financial health, but Daley warned the extra $548 million the city will have to pump into city police and fire pension funds by 2015 could leave homeowners stuck with higher property taxes.

“You cannot place the financial problems on the back of every homeowner in Chicago. Besides that, every business in Chicago. That will make our city basically a city that will have a financial disaster,” Daley said.

John Dudlak: It was difficult to continue manufacturing in the facility we were at and we were approached by WISPARK, which is south of Kenosha, Wisconsin.

Boguslaw Duczek: It was terrible. I talked to my wife. I talked to kids. I say, oh, boy. Oh, boy. If they move, what are we going to do?

Dudlak: I get a call from Rahm and he is just irate. He says, ‘I can’t believe that this is going on. How in the world could a 100 year old Chicago company move to WISPARK? You know’

And he said, “I’m going to look into this thing. It’s just not right.”

What he did was he made the city and the state and the developer see the logic of keeping employees in Chicago.

Delfin Perez: It surprise me you know because we’re not talking about 200 and 500 people, just about 30, 30 something people.

And he did a great job, so that we’d be able to stay in Chicago.

Dudlak: It’s just that he wants to do what’s right…

And he will just latch on to it and he’ll pursue it and pursue it and get it done. I wish more people had that kind of tenacity.

* Poll shows Rahm Emanuel as front-runner: The Chicago Retail Merchants Association poll of 2,255 voters taken Monday — the last day candidates could file to run for mayor —finds Emanuel leading a crowded field with support from 39 percent of respondents. Former U.S. Sen. Carol Moseley Braun came in a distant second with support from 12 percent of those polled. Former Chicago schools chief Gery Chico had 9 percent; Congressman Danny Davis, 7 percent; City Clerk Miguel Del Valle and Rev. James Meeks, 5 percent each; and outgoing U.S. Sen. Roland Burris, 2 percent.

* Petitions for Mayor Offer First Clues of Campaign: The Chicago News Cooperative’s review of all of the nearly 5,300 petitions for the Emanuel campaign found that a man from Mundelein, which is almost 40 miles from City Hall, circulated more signature pages than any other supporter. The analysis found that 4 of Mr. Emanuel’s top 6 circulators and 7 of his 20 busiest operatives wrote in home addresses for themselves outside Chicago at the bottom of the sworn affidavits that they had asked Chicago voters to sign. Almost 25 percent of the petition pages for Mr. Emanuel were circulated by campaign workers who do not live in Chicago, the analysis found.

* Today is Barton Lorimor’s last day as my intern. Barton has served us all well, so I wanted to take this opportunity to thank him for all his hard work and long hours.

I’ve developed great relations with all my interns, and it’s tough to see them go. Barton will definitely be missed.

Barton requested a song for our traditional Friday post. Booker T. and the MGs will play us out

* The Chicago Cubs owners have not had a great week. Their universally panned rollout of their taxpayer-financed stadium remodeling has been a massive failure so far. And they’ve now even managed to embarrass themselves during what ought to be a wildly favorable publicity stunt.

As you may know by now, Wrigley Field will play host to this weekend’s Illinois vs. Northwestern football game. The Ricketts family has ordered their park’s famous marquee painted “Wildcat Purple.” The outside of the stadium has been “swathed with Northwestern football pictures.” Everybody is just so excited.

Well, maybe not everybody. Because the field of play is so small, the teams will be able to use only one end-zone tomorrow

The east end zone is feet away from the right-field wall, and although there is padding, there was still concerns that injuries could take place. Northwestern coach Pat Fitzgerald had said he would have different game plans for the different end zones to avoid the possibility of injury.

When a team is on offense Saturday, it will be positioned to head to the west end zone.

From the Big Ten…

* All offensive plays will head toward the west end zone, including all extra points and all overtime possessions.

* All kickoffs will be kicked toward the east end zone.

* After every change of possession, the ball will be repositioned for the offense to head toward the west end zone.

* As a result of a coin toss held by the conference office Friday morning, Illinois will occupy the west team bench in the first half and Northwestern will occupy the west team bench in the second half and for all overtime periods.

Oy.

* Speaking of failures, remember William Kelly? He ran for state comptroller and failed. He was hired by an independent US Senate candidate to gather petitions and failed. He even failed when he tried to move a sign posted by the Freedom From Religion Foundation in the Statehouse rotunda.

Conservative radio ranter William Kelly and veteran TV reporter Jay Levine will get their day in court today following a Columbus Day quarrel when the two vied to interview mayoral candidate Rahm Emanuel.

• Backshot: Kelly — who owns airtime on WIND-AM (560) radio and who unsuccessfully attempted to rattle Emanuel with a barrage of frenetic questions — filed a misdemeanor assault complaint against WBBM-Channel 2 chief correspondent Levine, who tried to end Kelly’s obnoxious rant by threatening to ‘’deck'’ him. (The videotaped ruckus can be seen on YouTube.)

• The upshot: The case will be heard in Cook County court at Belmont and Western.

Disregarding a textbook case of assault, a Chicago judge granted Levine a “not guilty” verdict. I was hoping for justice today…but justice was not to be found. The fight continues!

Maybe next he’ll follow through with his claims of “assault” against a young woman who works for Rahm Emanuel.

Sheesh.

* And our failure quote of the day comes from failed Green Party gubernatorial nominee Rich Whitney on this month’s election results

The recent results across the board were “a pretty bitter pill,” Whitney says. “It was certainly disappointing, but in the Green Party we tend not to get too discouraged for too long.”

The Greens need to start learning from their failures rather than just being hopelessly optimistic. This advice from Dan Proft to the Illinois Republicans could just as easily apply to them

After losing three gubernatorial elections in a row to the corrupt and the incompetent, it is tempting for Illinois Republicans to say, “What the heck is wrong with the voters of Illinois?” when they should be asking, “What the heck is wrong with the Illinois Republican Party?”
