This just in… Repubs protest release of report *** White, Burris trade charges at court ***

Thursday, Jan 8, 2009 - Posted by Rich Miller

* 11:17 am - The House is going to caucus and adjourning until tomorrow morning at 9 o’clock. That’s when the impeachment debate and vote will take place.

The House impeachment committee will wrap things up today at 3 o’clock.

It’s almost over, folks. One more day.

By the way, tomorrow is Richard Nixon’s birthday. Appropriate.

Today is Elvis Presley’s birthday. Also appropriate.

* 12:19 pm - I should’ve mentioned this yesterday, but our beloved commenter “Bill” was at yesterday’s impeachment committee hearing.

*** 1:21 pm *** This isn’t unreasonable, but perhaps still a stretch

Republican Representatives like Jim Durkin, who’s from Western Spring, says that objectivity has been undercut by making public the committee’s report recommending Blagojevich be impeached before a committee vote, likely this afternoon.

DURKIN: Something of this magnitude, which we’re investigating, I think it’s important for us to follow the protocol and procedure, which we set out from the first date.

A spokesman for House Democrats says they wanted to make sure members of the House, and the general public, had adequate time to review the report before the committee considered it.

The vote will be up or down on the report itself. You can’t vote up or down if there are no conclusions in the report. So, I get what Durkin’s saying, I just don’t completely agree with it.

*** 1:31 pm *** Thanks to a commenter, Secretary of State Jesse White has replied to Roland Burris’ reply to White’s reply to Burris’ original filing, which seeks to force White to co-sign the governor’s appointment. Got all that? Go here for it all.

Without going into too much detail because I’ve gotta get moving soon, White’s latest filing is pretty devastating to Burris’ case, at least in my own opinion. They’re trying as hard as they can to punt this thing to Harry Reid and his hapless group of DC Democrats, and they seem to be doing a pretty good job of it. We’ll just have to wait and see how, when or even if, the Supreme Court rules on the matter.

Doesn’t a debate require a Pro and Con (pardon the pun) side? Ok who is going to be on the con side? Hoffman? Grandburg quit so he would not have to vote on this even though the Governor stung him along something terrible. We should have a contest to name how long the Debate will last.

    Burris isn’t testifying after all?

The Burris thing has lead me to ponder what will be enscribed upon Rich’s masoleum. I would bet it shall read in large letters…. BITE ME :)

Am I right in thinking the Senate trial is in no way limited by the House and its report in terms of what evidence can be introduced?

  10. - Lurker - Thursday, Jan 8, 09 @ 11:42 am:

Sorry - momentary reading comprehension problem, probably due to a (hopefully temporarily) nocturnal one-year-old.

A smarter Senate appointee might send the affidavit and not come to testify, but Roland needs more TV time, can’t resist the chance to speak at the mics.

Re: “What if the govenor refuses to convene the
Senate?”: Wasn’t he scheduled to be in court in
    Chicago on that date?

  13. - wordslinger - Thursday, Jan 8, 09 @ 11:56 am:

Burris was subpoenaed. I don’t think affidavit was an option.

  14. - Wacker Drive - Thursday, Jan 8, 09 @ 11:57 am:

Hopefully we will all be one step closer to removing Blago.
Hey Rod, it will be a Win-Win day for all of Illinois!

It’s almost over? This is just round one. Not that I expect the outcome of round two to be any different, but this will remain on the front pages for another month; to month and a half at least.

While I don’t think they should, I also have a sneaking suspicion that the Illinois Supremes could back both Madigan and White, and send Burris to Federal Court to seek his redress by seeking to invaldate the Senate Rule requiring the SOS signature.

The federal courts could deem this as an extra qualification requirement which is outside the scope of the constitutionally required qualifications. Reid and Durbin could be back on the front pages as well as a result, because they would have to choose whether to defend the 200+ year old rule, or just waive it and seat Burris.

By sending him to federal court, the IL SC could wash its hands of this matter, while at the same time exonerating White and Madigan, and send a message to Washington that “we’re not here to do your dirty work for you. If you want to continue to fight this go ahead, but do it in your own court and leave us out of it”

Rich: I thought a Holderman ruling on the release of the tapes was due today. What’s up?

Tomorrow is also birthday of Led Zeppelin’s Jimmy Page, he of - appropriately enough - “Dazed & Confused” fame.

  19. - Blago Sphere - Thursday, Jan 8, 09 @ 12:49 pm:

Jesse White’s filed his response to Burris reply yesterday.

This looks more and more to me like they are trying to nudge the ILSC to send Burris packing to federal court to seek his relief.

You gotta love the law don’t cha. I love reading these things “efectuate”. What about checks and balances? I didn’t read the Burris document but it seems as if “check and balance” is being exercised here with the refusal to sign which per reports yesterday regarding the “fall guy” White this was a group hug by the elected executive leaders!!! (checks and balances were created between the judicial, legislative and exceuctive branches - not necessarily at the same executive level - but it could be implied) Hmmm.

  22. - Anon - Thursday, Jan 8, 09 @ 2:12 pm:

Do you think they’ll fly a “W” flag at the Capitol tomorrow? :)

    ===Do you think they’ll fly a “W” flag at the Capitol tomorrow?===

Madigan’s a Sox fan, so I doubt it. lol

  24. - wordslinger - Thursday, Jan 8, 09 @ 3:02 pm:

White’s response to Burris wacky filing is devastating, but also a bit cute.

He’s now agreeing that his signature is not necessary for Burris to be seated. But that’s the reason he didn’t sign it in the first place, right? He did his bit, then Obama, Reid and Durbin sold him out.

    Jessy, you are the man!!!!!!!!!!!!!
