DeVore demands legislature reconvene

Thursday, Jul 30, 2020 - Posted by Rich Miller

* Rebecca Anzel at Capitol News Illinois

The attorney challenging aspects of Illinois Gov. JB Pritzker’s COVID-19 response said Wednesday he would halt the progress of his “dozen or so” lawsuits if legislators return to Springfield.

At the heart of Thomas DeVore’s many cases in several Illinois counties is the question of whether an Illinois governor is constitutionally and legally authorized to exercise unilateral control over the management of a disaster, such as the public health emergency posed by the novel coronavirus. […]

In an open letter DeVore sent to the General Assembly’s four legislative leaders Wednesday afternoon, the attorney wrote he is “imploring” lawmakers to determine rules for schools and businesses so both can safely resume operations without harming public health. […]

Spokespeople for three of the leaders — House Speaker Michael Madigan (D-Chicago), House Minority Leader Jim Durkin (R-Western Springs) and Senate Minority Leader Bill Brady (R-Bloomington) — did not return requests for comment at the time of publication.

A spokesperson for Senate President Don Harmon (D-Oak Park) wrote in an email that “the Senate has no plans at this time to reconvene before the scheduled veto session in November.”

I dunno. Maybe win a court case outside of Clay County first? Or at least allow something to be appealed?

Sheesh.

Run for the House or Senate.

    The courts aren’t the branch.

If he thinks he knows better than the legislature, perhaps he should run for office.

  3. - Anon E Moose - Thursday, Jul 30, 20 @ 11:59 am:

    What OW said.

  4. - Pundent - Thursday, Jul 30, 20 @ 12:02 pm:

Devore wants the legislature to do what no one outside of a lone Clay County judge has done, take him seriously.

  5. - Concerned Dem - Thursday, Jul 30, 20 @ 12:07 pm:

Wait… if I pay the $50 filing fee to bring a lawsuit against the state do I get the power to call them into special session too?

Sounds like each judicial circuit in the state just found an untapped source of revenue.

I am much much more comfortable having emergency health disaster decisions being made by the career health and disaster experts at the agencies and their unitary boss rather than a factional demagogic legislature where few members have the expertise to act

Andy Manar was on local radio this morning and indicated support for a return to session now for ethics. Not waiting.

That is cute Tommy. Will you hold your breath until they do?

  9. - the Patriot - Thursday, Jul 30, 20 @ 12:22 pm:

He needs an end game. He made a few bucks filing suits(many attorneys will file anything for a fee), but is probably getting over run with requests for everyone to file a suit.

Sort of something you were supposed to learn in law school…There is a difference between having a point, and having a case.

  10. - Candy Dogood - Thursday, Jul 30, 20 @ 12:23 pm:

Many times in my life I have encountered someone like Mr. DeVore who presumes they have power, authority, status, or some stature or another that grants them leverage they do not have.

The gall of this man to so actively fight to bring harm to others and harm to our state under the auspices of good intent.

===Run for the House or Senate.===

I’d put even money on this being an informal prelude to his campaign.

  11. - Anotheretiree - Thursday, Jul 30, 20 @ 12:25 pm:

Watching people be taken in by their own propaganda is fascinating. Devore may want to take not of Herman Cain. This is a dangerous time to believe nonsense. Clay and Scott counties are ticking upward now. Sangamon is sprinting acing ahead. Karma doesn’t like to be taunted too many times…

  12. - Cheryl44 - Thursday, Jul 30, 20 @ 12:25 pm:

Did I miss him being out in charge of stuff?

Well, he was elected to a school board once.

Actively working to reduce the population of people who might vote for you seems to be an odd approach though.

Well the executive bracnch is already trying to do that, but you don’t seem to like it. Part of me does wish they had dealt with this sooner, though, and another part of me wants them to pass something identical to what is already being done to shove it back in his face.

Does Thomas DeVore wear a beanie with a propeller?

  16. - DirtLawyer - Thursday, Jul 30, 20 @ 12:50 pm:

I for one would love to see DeVore run for and win a seat in the state Senate, just so I can watch Don Harmon run circles around him during sessions.

  17. - Jibba - Thursday, Jul 30, 20 @ 1:06 pm:

he would halt the progress of his “dozen or so” lawsuits

Getting to an appellate court would also halt the progress of his many lawsuits. A lot quicker, too.

  18. - pool boy - Thursday, Jul 30, 20 @ 1:29 pm:

Apparently he doesn’t read the Illinois COVID 19 daily updates.

  19. - Lurker - Thursday, Jul 30, 20 @ 2:53 pm:

Legislature not in person, school not in person.

I love the kids more than them, so this is easy.

=I for one would love to see DeVore run for and win a seat in the state Senate, just so I can watch Don Harmon run circles around him during sessions.=

Honestly, I think you have a good point. It isn’t like he is going to gain a seat for the ILGOP, he would just be replacing another wingnut, so it could be entertaining.

    Now do Pritzker….

  22. - Oswego Willy - Thursday, Jul 30, 20 @ 3:31 pm:

    === Now do Pritzker….===

    Huh?

    lol

  23. - Highland IL - Thursday, Jul 30, 20 @ 4:02 pm:

Jason has been quiet on this issue. He’s going to have a primary on his hands with this guy.

  24. - JoanP - Thursday, Jul 30, 20 @ 4:31 pm:

Well, I’m going to stomp my feet and hold my breath until I get a pony.

    That won’t work, either.
