Another day, another failed lawsuit

The possibility for high school students to play all fall sports is again at a standstill.

On Thursday, a DuPage County judge denied a request for a temporary restraining order against the Illinois High School Association that could have allowed more fall sports to be played.

The class action lawsuit, brought on by a group of student-athletes and their parents, was dismissed Monday morning.

Orland Park has dropped a federal lawsuit against Gov. J.B. Pritzker challenging restrictions put in place in response to the COVID-19 pandemic, according to court filings.

The village and other plaintiffs in the case had initially filed the complaint in mid-June, and last month told the judge overseeing the case it planned to file an amended lawsuit by this Thursday.

The short document filed Tuesday did not give an explanation why the village decided to voluntarily dismiss the lawsuit.

Three more DeKalb County restaurant owners are joining in on a lawsuit filed against Gov. JB Pritzker and the Illinois Department of Public Health alleging “unfair” regional mitigations due to COVID-19 resurgences.

Karlsbad Tavern & Grill, 413 W. Main St. in Genoa, Uncle Milty’s Pizza Place, 131 W. Market St. in Somonauk, and Rambo’s Bar & Grill, 140 W. Market St. in Somonauk joined seven other businesses owners across the county suing the the governor and IDPH Director Ngozi Ezike, according to their lawyer, Bradley Melzer, of Sycamore-based Cronauer Law Thursday.

The update comes a week after seven business owners announced they’re suing to appeal to public health officials to designate consequences of COVID-19 resurgences on a county by county basis, not regionally. They’re arguing that the metrics used to designate mitigations — including a positivty rate threshold of 8% — is unfairly skewed because of higher rates in Winnebago and surrounding counties.

    I’m sure DeVore will be upset about this on going down the tubes. He was boasting about the firm having 950 Attorneys on staff and this was the one the Governor wasn’t going to be able to push around. Seems it never came to that. So those 950? Attorneys didn’t have to do anything.

    Some football coaches and parents are getting some painful lessons on the judicial system. Maybe instead of worrying about their playbooks, coaches like Ken Leonard should try cracking open a textbook.

    Playing football in the spring could be a blessing in disguise. If Illinois is the only state playing football then, college scouts can spend more time focusing on Illinois players because they will be the only ones playing.

    The mayor in Orland Park has some big stink coming off of him, and I’m interested to see what happens now that he’s gotten the state’s attention.

    Petitions are being circulated now for spring municipal elections - including school boards, park districts and other local electeds who wasted taxpayer dollars on these frivolous lawsuits.

    The the restaurants.

    These towns need to start looking at the big picture. Every time I hear a name of a restaurant and the town it is in, the only thing I’m remembering is the town it is in. That means I won’t be eating at any places in that town, and more likely won’t ever be going to that town at all.

    Generational reputations are being created in this, by those who can’t see how their actions are impacting anything beyond next week.

    I will say one thing in closing, I’m not the least bit surprised that the chamber of commerce is doing the most harm to commerce in these towns.

    Compare and contrast how we’re handling these issues with our neighbors to north in Wisconsin. The Governor and Legislature are divided. Lockdowns gets overturned, restrictions and limitations get removed, mask mandates are litigated. And the case count, hospitalization rates and deaths continue to climb. But hey, at least they’ve got H.S. football.
