Winnebago County State’s Attorney J. Hanley said he may no longer be part of a multi-county lawsuit challenging the constitutionality of the SAFE-T Act.
Hanley told the Rockford Register Star Tuesday he is considering withdrawing his name from the suit after Illinois Governor JB Pritzker signed a series of amendments to the SAFE-T Act.
“It would be irresponsible of me,” he said, “not to monitor or to continue to think about the advisability of continuing litigation.”
Hanley also said he regrets if any of his comments leading up to the Nov. 8 elections contributed to the “hysteria” over the elimination of the cash bail system on Jan. 1, 2023.

This guy is trying to salvage his reputation. Good luck with that. He has a better chance of doing so than those who are going to keep quiet and hope nobody notices what they did and said.
The rest of the SAs seem to have gone completely silent, coincidentally timed with the end of the election. Which seems strange if they are still concerned with something that isn’t going to happen for 3 more weeks.

I am thankful for that, but let’s keep in mind the idea *why* those comments existed, and what was the purpose of those comments
Make no mistake, it’s a pathetic “crawl back under the rock” move, not a thoughtful walk back to policy.

I just hope folks remember the names of people who launched such bad faith attacks. It feels like a lot of the officials and organizations who said the sky was falling with cannabis legalization said the same thing about pretrial fairness. And yet few seemed bothered enough to point out that some credibility should have been lost by the fact that the sky hasn’t fallen yet…

That’s doubtful, as those who hurt an entire STATE for two years try and succeed in mainstream newspapers that they somehow had nothing to do with a two year disaster…
… but I digress…
My hope is this is a lesson.
Unlike so many who chose to purposely hurt Illinois, there’s an apology here. A recognition of the damage (real or otherwise) and there’s regret.
That part I’m grateful for, as I remember why this SA did what was done.

It was easy to stand in opposition to the SAFE-T act when it was being defined, often incorrectly, by political ads. But courts require you to have a legitimate objection and argue on merits not politics.

Wouldn’t dropping out prove that the act itself was political theater? If Hanley believed it was serious enough to challenge the legislation before the election, then he should have the content of character to follow through on his actions. Changing his mind is sort of, well, flip-flopping.
