Feds lose yet another case

A federal judge has ruled that a controversial security fence constructed around the U.S. Immigration and Customs Enforcement detention facility in Broadview is violating the west suburb’s right to access its own land and ordered its removal.
In a ruling Thursday night, U.S. District Judge LaShonda Hunt said it was clear from the government’s own arguments that “there is no plan to take the fence down and that ‘Operation Midway Blitz‘ currently has no end in sight.”
In addition, the judge said, ICE Acting Director Todd Lyons wrote in a letter to the village that the agency has an issue with “unlawful assemblies” of protesters and there “will be no change in our operational posture” until the demonstrations stop.
“In other words, the (defendants’) current operations are indefinite and the protests — which Acting Director Lyons seemingly considers to fall into the category of ‘unlawful activities’ — will undoubtedly continue,” Hunt wrote in her opinion. “Under these circumstances, the court concludes that because the persistent protests are a direct response to the defendants’ ongoing operations, there is no reason to believe that they will end and that the fence will be voluntarily removed any time soon.”
The fence must be removed by Friday, the judge ordered.

Just before election day in 1999, he tore up a bunch of sidewalks in front of polling places that were friendly to anti-Machine candidates. Then, of course, the Meigs Field raid.
To answer your question, I think he might’ve torn up the entire street in order to perform “emergency repairs” on “badly aging” sewer and water lines.

I would hope Broadview would make them take out the plywood over the windows. That has to be against code. What if there was a fire inside? No exits and smoke stuck in building.

That’s what I miss. Savvy politicians that could get their point across without lawsuits or threats to the Constitution.
Guile, wit, and a heady dose of common sense and street smarts.
We’re they angels? No. But there wasn’t this constant pall of despair.

Riiiigghht…it’s the *courts* that are overstepping their bounds. Not the jackboots in facemasks grabbing people off the street and tear gassing clergy. Thanks for alerting me to this threat.

My third generation Mexican-American wife has to carry her passport around in case she’s detained based on the way she looks, which they have admitted they are doing.

The Broadview Fire Chief concluded that the boarded windows were not against fire code.

Joe - I feel your pain. My wife who was born in Brazil is concerned about being picked up and carries her passport as well.
The fear of the current actions being carried out by the federal government is pervasive. I fear for several friends who are naturalized citizens from Egypt, India, and the Philippines. The idea that they could be snatched off the street because of the color of their skin is horrific.

At the risk of messing with a good meme about how a Chicago mayor would handle ICE fencing, the Village of Broadview is not within the city limits of Chicago or even borders it. So there’s not much a Mayor Daley (Richard J. or Richard M.) could actually do.

Sort of. If they don’t think the court will do their bidding many maga’s would just as soon prefer extra judicial actions. They are ok with that unless it is their overlord on the hook.

Courts overstepping their bounds? Like the imaginary immunity in the Constitution of the United States of America. And some of the judges call themselves “originalists”.
